government, who refuses or wilfully neglects to keep the accounts of his office in the manner and form prescribed by the Auditor General, or to make the reports herein provided, or who refuses or neglects to comply with any other requirements of this act. It shall be the duty of the Auditor General Hearing. to promptly report to the Governor, each such refusal or neglect and thereupon the Governor, before taking final action thereon, shall summons the officer complained against to make answer why he should not be removed from office.

SEC. 11. Any person who shall give or offer to any examiner, accountant, clerk or other employe of the Auditor General's department, any money, gift, emolument, or thing of value for the purpose of influencing the action of such examiner, or other person, in any matter relating to the examination of any public account authorized by this act, or for the purpose of preventing or delaying the examination of any such public account, or for the purpose of influencing the action of such examiner, or other person, in framing, changing, withholding or delaying any report of any examination of any such public account shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by Penalty. a fine of not more than one thousand dollars nor less than two hundred dollars, or he may be imprisoned in the Detroit House of Correction for a period of not more than six months and not less than thirty days, or he may be punished by both such fine and imprisonment, in the discretion of the court. SEC. 12. Any person appointed by the Auditor General to make the examinations herein provided, or any officer, clerk receiving or other employe of the Auditor General's department, who shall receive, or solicit any money, gift, emolument, or anything of value for the purpose of being influenced in the matter of the examination of any public account authorized by this act, or for the purpose of being influenced to prevent or delay the examination of any such public account, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than one thousand dollars and not less than two hundred dollars, or he may be imprisoned in the Detroit House of Correction for a period of not more than six months and not less than thirty days, or he may be punished by both such fine and imprisonment, in the discretion of the court.

SEC. 13. The Auditor General shall estimate, as near as may be, the amount of money necessary to meet the expense expense. of administering the provisions of this act during each year of the biennial period, commencing the first day of July,

nineteen hundred nineteen, and he shall make a similar estimate every two years thereafter: Provided, That if the legis lature shall provide for a budget system of making and controlling appropriations, then, and in that case, the duty imposed upon the Auditor General by this section shall thereafter be discharged by a budget commission or budget commissioner, as the case may be, and the expense of administering the provisions of this act shall be met by a specific appropriation, included in the budget. There is hereby appropriated from the general fund of the State a sufficient amount to meet the expenditures necessary to carry out the requirements of this act, and the Auditor General is hereby directed to incorporate in the State tax a sufficient amount to reimburse the general fund for the money drawn from it for the purposes herein provided.

SEC. 14. Act number one hundred eighty-three of the Public Acts of nineteen hundred eleven, and all other acts or parts of acts, contravening the provisions of this act, are hereby repealed.

This act is ordered to take immediate effect.

AN ACT to amend section one of act number eleven of the Public Acts of nineteen hundred eleven, entitled "An act designating the days to be observed as holidays in the public schools of this State," being section five thousand eight hundred twenty-three of the Compiled Laws of nineteen hundred fifteen.

The People of the State of Michigan enact:

SECTION 1. Section one of act number eleven of the Public Acts of nineteen hundred eleven, entitled "An act designating the days to be observed as holidays in the public schools of this State," being section five thousand eight hundred twenty-three of the Compiled Laws of nineteen hundred fifteen is hereby amended to read as follows:

SEC. 1. The following days, namely, the first day of January, commonly called New Year's day, the thirtieth day of May, commonly called Memorial day, the fourth day of July, commonly called Independence day, the first Monday of September, commonly called Labor day, and the twenty-fifth day of December, commonly called Christmas day, all Saturdays and all days appointed or recommended by the Governor of this State or the President of the United States as days of

fasting and prayer or thanksgiving shall, in all the public schools of the State, be treated and considered as public holidays and on such above specified days there shall be no school sessions in any of such public schools of this State: Provided, That the salary of school officers and teachers shall be in no way affected by reason of the dismissal of school on any of the above mentioned days: Provided further, That on the following days, namely, the twelfth day of February, commonly called Lincoln's birthday, the twenty-second day of February, commonly called Washington's birthday, the seventeenth day of September, being the date of the adoption of the federal constitution, the twelfth day of October, commonly called Columbus day, the twenty-seventh day of October to be known as Roosevelt's birthday, and the eleventh day of November, commonly called Liberty day, it shall be the duty of all school officers and teachers to have the schools under their respective charge observe such mentioned days, namely, the twelfth day of February, the twenty-second day of February, the seventeenth day of September, the twelfth and twenty-seventh days of October, and the eleventh day of November, by proper and appropriate commemorative exercises, and such days shall not be considered as legal holidays for schools. AN ACT to standardize the gauge of vehicles to be used on the public highways of this State and to regulate the manufacture, sale and use thereof.

The People of the State of Michigan enact:

SECTION 1. Any person, firm or corporation, violating the provisions of this act shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in the sum of not less than five dollars nor more than twenty-five dollars, or be confined in the county jail for not less than five days nor more than twenty-five days, or both such fine and imprisonment in the discretion of the court.

AN ACT to amend section twenty-nine of act number two hundred five of the Public Acts of eighteen hundred eightyseven, entitled "An act to revise the laws authorizing the business of banking, and to establish a banking department for the supervision of such business," being compilers' section seven thousand nine hundred ninety-eight of the Compiled Laws of nineteen hundred fifteen, as amended by act number one hundred ninety-four of the Public Acts of eighteen hundred ninety-three, and by act number one hundred ninety-three of the Public Acts of nineteen hundred nine.

The People of the State of Michigan enact:

SECTION 1. Section twenty-nine of act number two hundred five of the Public Acts of eighteen hundred eighty-seven, entitled "An act to revise the laws authorizing the business of banking, and to establish a banking department for the supervision of such business," as amended by act number one hundred ninety-four of the Public Acts of eighteen hundred ninety-three and by act number one hundred ninety-three of the Public Acts of nineteen hundred nine, is hereby amended to read as follows:

SEC. 29. Any bank combining the business of a commercial bank and a savings bank shall keep separate books of account for each kind of business: Provided, That all receipts, investments and transactions relating to each of said classes of business shall be governed by the provisions and restrictions herein specifically provided for the respective kinds of banks: Provided further, That all the investments relating to the savings department shall be kept entirely sepa
