An Act to permit the taking of suckers by means of set-over nets in Long, Corey, Kaiser and Clear lakes in St. Joseph county and in Wall lake in Barry county during certain seasons of the year.

The People of the State of Michigan enact:

WHEN USE OF SET-OVER NETS LAWFUL.

(193) SECTION 1. Hereafter it shall be lawful to take suckers by means of set-over nets in Long, Corey, Kaiser and Clear lakes in St. Joseph county and in Wall lake in Barry county from April first to May tenth, both inclusive, in any year: Provided, That not to exceed fifteen suckers shall be so taken in any one day by any one person.

SET-OVER NET DEFINED.

(194) SEC. 2. For the purposes of this act a set-over net shall consist of a circular frame of not more than six feet in diameter, covered with netting of not less than one inch mesh, and the means of capture shall be by dropping said net over the fish in shoal water near the shores of said lakes.

PENALTY.

(195) SEC. 3. Any person or persons who shall take any other fish than suckers by means of such nets, or shall take in excess of the number of suckers allowed by this act, shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than ten dollars nor more than one hundred dollars, or shall be imprisoned in the county jail for not less than ten days nor more than three months, or by both such fine and imprisonment in the discretion of the court.

An Act to prohibit spearing or shooting fish in Goguac lake in the township of Battle Creek, in Calhoun county.

The People of the State of Michigan enact:

UNLAWFUL FISHING IN GOGUAC LAKE.

SECTION 1. That it shall not be lawful to take or catch any fish in Goguac lake in the township of Battle Creek, in the county of Calhoun, with spear, or by shooting them with firearms.

PENALTY.

(197) SEC. 2. Any person violating section one of this act shall be deemed guilty of a misdemeanor, and on conviction thereof shall be liable to a fine not to exceed fifty dollars and costs of suit, or by imprisonment in the county jail not to exceed thirty days, in the discretion of the court.

An Act to regulate the catching of fish in the waters of Long lake in Genesee county and to repeal all acts or parts of acts inconsistent herewith.

The People of the State of Michigan enact:

UNLAWFUL TO FISH, EXCEPT WITH HOOK AND LINE.

(198) SECTION 1. It shall not be lawful for any person at any time to take, catch or kill, or attempt to take, catch or kill, any fish of any kind by any means whatever, except with a hook and line, in any of the waters of Long lake in Genesee county.

PENALTY.

(199) SEC. 2. Any person violating any of the provisions of this act shall be deemed guilty of a misdemeanor, and upon conviction thereof, before any court of competent jurisdiction, shall be punished by a fine of not less than five dollars nor more than fifty dollars for each offense, and the costs of prosecution, and in default of payment thereof, shall be imprisoned in the county jail until such fine shall be paid, but such imprisonment shall not exceed thirty days.

An Act to prevent the destruction of fish in Reed's lake and Fisk's lake, in the township of Grand Rapids, in the county of Kent.

The People of the State of Michigan enact:

UNLAWFUL FISHING IN CERTAIN LAKES.

(200) SECTION 1. That it shall not be lawful hereafter to take or catch any fish in the lake known as Reed's lake, or the lake known as Fisk's lake, in the township of Grand Rapids, in the county of Kent, with the spear, or by shooting them with any firearms.

See sections 263-64.

PENALTY.

(201) SEC. 3. Any person offending against the provisions of this act shall, on conviction thereof, be liable to a fine of not more than five dollars.

Section 2 superseded by Act 236 of 1915, (§ § 7654-67 C. L. 1915). See sections 46-60.

An Act to regulate the taking and catching of fish in Great Sauble lake, commonly known as Hamlin lake, in Mason county, Michigan.

The People of the State of Michigan enact:

UNLAWFUL TO FISH, EXCEPT WITH HOOK AND LINE.

(202) SECTION 1. It shall not be lawful for any person to take, catch or kill, or attempt to take, catch or kill any fish in Great Sauble lake, commonly known as Hamlin lake, in Mason county, with any kind of spear or grab-hook, or by the use of jacks or artificial light of any kind, or by the use of set lines or night lines,

or any kind of net, or any kind of firearms or explosive, or any other service except the hook and line.

PENALTY.

(203) SEC. 2. Any person violating any of the provisions of this act shall be deemed guilty of a misdemeanor, and upon conviction thereof, before any court of competent jurisdiction, shall be punished by a fine not to exceed twenty-five dollars and costs of prosecution, or imprisonment in the common jail of Mason county not to exceed sixty days, or by both, such fine and imprisonment in the discretion of the court.

An Act to provide for the protection of fish in the lakes known as Whitefish lake and Little Whitefish lake, in the township of Pierson, county of Montcalm and state of Michigan.

The People of the State of Michigan enact:

NETS, SPEARS, TRAPS AND FISHING SHANTIES PROHIBITED.

SECTION 1. That it shall be unlawful to take, catch, kill or destroy fish with seines or any species of continuous net, or with any form of spear or trap, or in any manner whatsoever, except with hook and line, in the waters of said Whitefish lake and Little Whitefish lake, in the township of Pierson, Montcalm county, Michigan, and that it shall be unlawful to employ the use of fishing shanties or tents of any kind whatsoever for fishing through the ice on said lakes.

PENALTY.

(205) SEC. 2. Any person violating any of the provisions of section one of this act shall be deemed guilty of a misdemeanor and upon conviction thereof, before any court of competent jurisdiction, shall be punished by a fine not to exceed one hundred dollars or imprisonment in the county jail for a period of not exceeding ninety days or by both such fine and imprisonment in the discretion of the court.

An Act to provide for screening the outlet and inlets of Tamarack lake in the township of Cato, Montcalm county, and to prohibit fishing in said lake in any manner, except with the hook and line.

The People of the State of Michigan enact:

WARDEN TO SCREEN TAMARACK LAKE.-EXPENSE.

(206) SECTION 1. That it shall be the duty of the state game and fish warden to provide and maintain wire screens of meshes one inch square, at the outlet and inlets of Tamarack lake, Montcalm county of this state, for the purpose of preventing fish from passing out of said lake, and for the propagation of fish therein. The expense of the construction and maintenance of such screens shall be certified by the state game and fish warden and audited by the board of trustees of the village of Lakeview, a corporation in said Montcalm county, and be paid out of any money belonging to the general fund of said village not otherwise appropriated.

UNLAWFUL TO FISH, EXCEPT WITH HOOK AND LINE.

(207) SEC. 2. It shall be unlawful for any person to take, catch or kill any fish in Tamarack lake in said county of Montcalm, with a spear, net, grab-hook, or by use of jacks or artificial light, or any kind of firearms or explosive material, set lines or other device whatsoever, except the hook and line in the hand, or in immediate control.

PENALTY FOR DESTRUCTION OF SCREENS.

(208) SEC. 3. Any person destroying, injuring or removing any of the screens provided for in section one of this act, or violating any of the provisions of section two of this act shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not to exceed twenty-five dollars and costs of prosecution, or imprisonment in the county jail not to exceed thirty days.

EVIDENCE OF VIOLATION.

(209) SEC. 4. In all prosecutions under this act it shall be prima facie evidence on the part of the people, of the violation of the provisions of this act, to show that the defendant was found upon the waters of said lake with spear, net, trap net, jack or artificial light of any kind, or with dynamite, giant powder or any explosive substance or combination of explosive substances.

An Act to provide for screening the outlet and inlets of Bills lake in the township of Croton, Newaygo county, and to prohibit fishing in said lake in any manner, except with the hook and line, and to provide a penalty for the violation thereof.

The People of the State of Michigan enact:

WIRE SCREENS, MESHES.-EXPENSE, HOW PAID.

(210) SECTION 1. That it shall be the duty of the state game, fish and forest fire commissioner to provide and maintain wire screens of meshes one inch square, at the outlet and inlets of Bills lake, Newaygo county of this state, for the purpose of preventing fish from passing out of said lake, and for the propagation of fish therein. The expense of the construction and maintenance of such screens shall be certified by the state game, fish and forest fire commissioner and audited by the township board of Croton township, said county, and be paid out of any money belonging to the general fund of said township not otherwise appropriated.

SPEARS, NETS AND GRAB HOOKS PROHIBITED.

(211) SEC. 2. It shall be unlawful for any person to take, catch or kill any fish in Bills lake, in said county of Newaygo, with a spear, net, grab hook, or by use of jacks or artificial light, or any kind of firearms or explosive material, set lines or other device whatsoever, except the hook and line in the hand, or in immediate control.

PENALTY.

(212) SEC. 3. Any person destroying, injuring or removing any of the screens provided for in section one of this act, or violating any of the provisions of section two of this act shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not to exceed twenty-five dollars and costs of prosecution, or imprisonment in the county jail not to exceed thirty days.

WHAT PRIMA FACIE EVIDENCE.

(213) SEC. 4. The People of the State of Michigan enact:

UNLAWFUL TO FISH, EXCEPT WITH HOOK AND LINE.

SECTION 1. That hereafter it shall not be lawful to catch, kill or destroy fish with seines or any species of continuous net or with any form of spear or trap or in any manner whatsoever except with hook and line in the waters of Pentwater lake, in the township of Pentwater, county of Oceana, or in the channel leading from said Pentwater lake to Lake Michigan.

PENALTY.

(215) SEC. 2. Any person violating any of the provisions of section one of this act shall be deemed guilty of a misdemeanor and upon conviction thereof before any court of competent jurisdiction shall be punished by a fine of not to exceed one hundred dollars or imprisonment in the county jail for a period not exceeding ninety days or by both such fine and imprisonment in the discretion of the court.

An Act for the protection of fish in the lake known as Rush lake situated in the township of Lake, county of Huron, state of Michigan.

The People of the State of Michigan enact:

UNLAWFUL TO FISH, EXCEPT WITH HOOK AND LINE.

(216). SECTION 1. Hereafter it shall not be lawful to catch, kill or destroy fish with seines or any species of continuous net or with any form of spear or trap or in [any] manner whatsoever except with hook and line in the waters of Rush lake, county of Huron, or in the tributary streams and outlets of said Rush lake within said township of Lake.

PENALTY.

(217) SEC. 2. Any person violating any of the provisions of section one of this act shall be deemed guilty of a misdemeanor and upon conviction thereof before any court of competent jurisdiction shall be punished by a fine of not to exceed one hundred dollars or imprisonment in the county jail for a period not exceeding ninety days or both such fine and imprisonment in the discretion of the court.
