Mr. Culver moved to reconsider the vote by which the House today did not pass Senate Bill No. 1 (file No. 1).

The Speaker ruled that the motion was not in order, for the reason that the vote had once been reconsidered.

Senate Bill No. 32 (file No. 161), entitled

A bill to amend section 1 of chapter III of Act No. 314 of the Public Acts of 1915, the Judicature Act of 1915, being section 12229 of the Compiled Laws of 1915,

Was read a third time and not passed, a majority of all the members-elect not voting therefor, by yeas and nays, as follows:

Mr. Hopkins, having reserved the right to explain his vote, made the following statement:

"Now, gentlemen of the House, I am really disappointed. I really believe you think you are doing something good, the same as you did on the other bill you passed here. You are trying to do something to help the poor boy yet you are opposed to the judge of probate being an attorney. In other words, when the poor boys come to have their estates judged they will have to pay a fee to an attorney which they wouldn't have to do if the judge of probate could do otherwise. I am very glad that you understood the bill.”

Senate Bill No. 157 (file No. 114), entitled

A bill to provide for and regulate the planting of useful, ornamental, nutbearing and food-producing trees and shrubs along the streets, highways and public thoroughfares within the State of Michigan, for the maintenance, protection and care of such trees and shrubs; and to repeal Act No. 36 of the Public Acts of 1919, entitled "An act to regulate the planting of ornamental, nut-bearing or other food-producing trees along the highways of the State of Michigan, or in public places, and for the maintenance, protection and care of such trees and to provide a penalty for injury thereof, or for stealing the products thereof," approved March 28, 1919,

Was read a third time, and, the question being on its passage,

Mr. Hart moved to amend the bill by inserting in line 1 of section 2 after the word "cities" the words "of less than 50,000."

The motion did not prevail and the amendment was not adopted, a majority of all the members-elect not voting therefor.

Mr. Lord moved that the bill be laid on the table.

The motion prevailed.

A bill to prohibit any mutual fire, cyclone, automobile or hailstorm insurance company taking or assuming a greater risk or liabality on a single hazard than one-fifth of one per centum of the total insurance in force in said company. The committee recommended that the bill pass.

The bill was referred to the Committee of the Whole and placed on the general orders.

The Committee recommended the adoption of the following amendment thereto, and the passage of the bill when so amended:

Amend by inserting in line 20 of Section 4 after the word "fowl," the words, "or for the taking of fish for commercial purposes from the waters of Lakes Superior, Michigan, Huron, and Erie and the Bays thereof."
