WE THE UNDERSIGNED, state canvassers, from an examination of the election returns received by the Secretary of State, determine that, at the primary election held on the sixth day of September, nineteen hundred ten,

Mr. White offered the following resolution:

Senate resolution No. 1.

Resolved, That the rules of the last session be adopted as the rules of this body for the present session.

The question being on the adoption of the resolution

Mr. Mapes demanded a division of the question, and requested that the vote be taken on the adoption of the rules with Rule No. 4 excepted. Pending which

Mr. Fowle moved to amend the resolution by inserting after the second word "the" the word "temporary."

The amendment did not prevail.

The question being on the adoption of the resolution offered by Mr. White, relative to the adoption of the rules of the last session, for the present session, with Rule No. 4 excepted.

The resolution was adopted.

Mr. Collins moved that Rule No. 4, of the rules of the last session be adopted,

Pending which

Mr. Mapes offered the following substitute for present Rule 4:

Rule 4. The Senate shall elect from its own members a committee of five to be known as "The Committee on Committees," to recommend the appointment of the membership of all committees and to report its recommendations to the Senate for adoption or rejection,

On which substitute he demanded the yeas and nays.

The substitute was then not adopted, a majority of the Senators present not voting therefor by yeas and nays, as follows:

The question being on the adoption of Rule 4, of the last Senate,
The motion prevailed.

Mr. Mapes sent to the Secretary's desk and had read the following statement:

Availing myself of my constitutional right, I desire to have entered on the Journal my dissent against the adoption of former Senate Rule No. 4, which reads:

"The President, unless otherwise directed, shall appoint all committees,"

For the reason that it is wrong in principle and contrary to the best and most progressive thought of the time. The responsibility for all legislative and other action of the Senate rests with its members and this most important function, the appointment of committees, should not be delegated to one who has no voice in its proceedings and no responsibility for the passage or defeat of any measure, or for any other action of the Senate..

The President announced that the statement would be entered on the Journal.

Mr. Kingman offered the following resolution:

Senate resolution No. 2.

Resolved, that in the proceedings of the Senate and of its committee of the whole, no second shall be required as a condition to the consideration of any motion or resolution.

Mr. White arose to a point of order and stated that in his judgment the resolution was out of order for the reason that it was practically an amendment to the Senate rules, to amend which required one day's notice.

The President declared the point of order well taken.

Mr. Kingman gave notice that at some future day he would move to amend the Senate rules.

Mr. Taylor moved that the Senate proceed to the election of officers. The motion prevailed.

The President announced that the Senate would proceed to the election of a President pro tem.

The roll of the Senate was then called and the Senators voted as follows:
