The Senate met pursuant to adjournment and was called to order by the President.

Religious exercises were conducted by Rev. Jonathan A. Sprague. The roll of the Senate was called by the Secretary.

The following Senators were present:

PRESENTATION OF PETITIONS.

Petition No. 24. By Mr. James: Petition of Martin Gustafson and 12 other residents of Laird township, Houghton county, urging an amendment to the game laws which will provide an open season for killing beaver.

The petition was referred to the Committee on Gaming Interests.

MOTIONS AND RESOLUTIONS.

Mr. Vaughan moved that one thousand extra copies of
Senate bill No. 79 (file No. 68), entitled

A bill to amend sections 8, 9, 10, 13, 14, 16, 18, 26, 36 and 38 of Act No. 207 of the Public Acts of 1889, approved June 29, 1889, entitled "An act to prohibit the manufacture, sale, keeping for sale, giving away or furnishing of vinous, malt, brewed, fermented, spirituous or intoxicating liquors or beverages, and to suspend the general laws of the State relative to the taxation and regulation of the manufacture and sale of such liquors in the counties of this State under certain circumstances; to authorize the qualified electors of the several counties of this State to express their will in regard to such prohibition by an election, and to authorize and empower the boards of supervisors of the several counties, after such election, if they shall determine the result to be in favor of such prohibition, to prohibit the manufacture, sale, keeping for sale, giving away or furnishing of any such liquors, or the keeping of a saloon or any other place for the manufacture, sale, storing for sale, giving away or furnishing of the same within their respective counties; and to provide for penalties and rights of action in case of its violation," as amended and added to by Act No. 183 of the Public Acts of 1899, approved April 18, 1899, Act No. 170 of the Public Acts of 1903, approved June 3, 1903, and Act No. 107 of the Public Acts of 1909, approved May 19, 1909, and to add one new section to stand as section 40; Be printed for the use of the Legislature.

Mr. Kingman moved to take from the table Senate bill No. 24 (file No. 37), entitled

A bill to amend Act No. 110 of the Public Acts of 1889, entitled "An act to provide for the re-organization of corporations or associations for religious, charitable, benevolent or educational purposes, the corporate term of existence of which has heretofore expired, or may hereafter expire by limitation, and to fix the duties and liabilities of such renewed corporations or associations," as amended by Act No. 85 of the Public Acts of 1897, being compiler's sections 8307 and 8308 of the Compiled Laws of 1897 by adding one new section thereto to stand as section 3.

The motion prevailed.

Mr. Kingman moved that the bill be re-referred to the Committee on Religious and Benevolent Societies.

Mr. Kline offered the following resolution:
Senate resolution No. 45.

Whereas, There is now pending in the Senate of the Congress of the United States, a bill known as the Sulloway Pension Bill which-provides that all veterans of the Mexican and Civil wars shall receive a pension of Fifteen Dollars per month at the age of sixty-two, Twenty Dollars at the age of sixty-five, Twenty-Five dollars at the age of seventy and Thirtysix Dollars per month at the age of seventy-five years. The bill also provides that all veterans who are wholly incapacitated to perform labor shall receive a pension of Thirty-six Dollars per month with no age limitation. The bill above referred to has already passed the House of Representatives by an overwhelming vote and is now pending in the Senate. Therefore be it

Resolved by the Senate (the House of Representatives concurring), that the Michigan Legislature go on record as favoring the early enactment of this bill and that a copy of this resolution be forwarded at once to the United States Senators from Michigan, urging them to use every effort to secure the passage of the bill.

The question being on the adoption of the resolution,

A bill to repeal Act No. 9 of the Public Acts of 1877, entitled "Ar act to authorize the appointment of a commissioner of mineral statistics, and defining the duties and compensation of the same," approved February 8, 1877, as amended, being sections 4630, 4631, 4632, 4633, 4634 and 4635 of the Compiled Laws of 1897; to abolish the office of commissioner of mineral statistics; and to provide for continuing the duties of said commissioner under the direction of the state board of geological survey; With the recommendation that the bill pass.

A bill to amend section 1 of Act No. 17 of the Public Acts of 1903, entitled "An act to amend the title and sections 1 and 29 of an act, entitled 'An act to establish, protect and enforce by lien the rights of mechanics and other persons furnishing labor or materials for building, altering, improving, repairing, erecting or ornamenting of buildings, machinery, wharves, and all other structures, and to repeal all acts contravening the provisions of this act,' being chapter 296 of the Compiled Laws of 1897," approved March 26, 1903;

With the accompanying substitute therefor, having the following title: A bill to amend section 1 of Act No. 179 of the Public Acts of 1891, approved July 1, 1891, entitled "An act to establish, protect and enforce by lien the rights of mechanics and other persons furnishing labor or materials for the building, altering, improving, repairing, erecting or ornamenting of buildings, machinery, wharves and all other structures; and to repeal all acts contravening the provisions of this act," the same being section 10710 of the Compiled Laws of 1907; as last amended by Act No. 121 of the Public Acts of 1909, approved May 26, 1909.

And recommend that the substitute be printed for the use of the committee.
