CHAPTER 80.

MUNICIPALITIES JUDGMENTS-PAID FROM SINKING FUNDS.

(SENATE BILL No. 259.)

AN ACT to amend section 6773 of chapter 66, article 2 of the Revised Laws of Oklahoma of 1910, and to provide for levying a tax to pay judgments against municipalities when the same has been paid out of the sinking fund of such municipality or which may hereafter be so paid, and providing that when such tax is so levied and collected the same shall be turned into the sinking fund out of which such judgment has been or may hereafter be paid; and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Judgments Against Municipality-Payment from Sinking Funds-Reimbursement.

Section 1. That section 6773 of chapter 66, article 2, of the Revised Laws of Oklahoma of 1910, be and the same is hereby amended to read as follows:

(Application.) Such sinking funds shall be

First. For the payment of interest coupons as they fall due. Second. For the payment of bonds falling due, if any such there be, and,

Third. For the payment of judgments against the municipality, if any there be; provided, that when any sinking fund has been used or may hereafter be used to pay judgments as herein provided, that notwithstanding the fact that such judgment or judgments have been paid with such sinking fund, it shall be the duty of the proper officers to make levies to pay such judgments the same as if the same had not been paid out of such sinking fund, and when so levied and collected the same shall be turned into the sinking fund out of which such judgment or judgments was paid.

Emergency.

Section 2. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof this Act shall take effect and be in full force from and after its passage and approval.

CHAPTER 81.

WEIGHTS AND MEASURES-ESTABLISH MENT OF STANDARDS

-STATE BUREAU.

(HOUSE BILL No. 442.)

AN ACT creating a State Bureau of Standards of Weights, Measures, and Tests and of methods of weighing, measuring and testing; locating the same; providing for its control and government; defining its powers and duties.

Be It Enacted by the People of the State of Oklahoma:

State Bureau Established-Officers-Location.

Section 1. There shall be established a State Bureau of Standards of weights, measures and tests of all kinds. This bureau shall be located at the State University of Oklahoma; which shall provide rooms and equipment for its use. The president of the State University of Oklahoma shall appoint as director of the Bureau of Standards a member of the regular faculty of the university. Upon the recommendation of the director, the president of the State University of Oklahoma shall appoint at least two members from the faculty, as assistant directors. The director and assistant directors shall constitute a Board of Control of the Bureau of Standards. The members. of the Board of Control shall serve without salary.

Assistants.

Section 2. In order properly to carry on the work of the Bureau of Standards, the president of the State University of Oklahoma shall upon the recommendation of the Board of Control, appoint as assistants to the Board of Control, men already in the service of the university, assigning to these men such titles as he desires. In case additional assistance is necessary, this assistance shall be supplied by the State Board of Education.

Standards and Methods-Federal Standards.

Section 3. The Board of Control shall have charge of the various standards of weights, measures and testing devices reIceived by the state of Oklahoma from the United States under a resolution of Congress, approved June 14, 1836, and July 27, 1866, and such additional standards as may or shall be received from the United States in the future. The board shall also have charge of the various state or office standards purchased by the State University, or by the state for the bureau.

The board shall also have charge and control of the standard methods of weighing, measuring and testing in the state. The Board of Control shall maintain the standards in good order and shall submit a set of standards, called the primary standards, at proper intervals, to the National Bureau of Standards for certification.

Powers and Duties-General Control.

Section 4. The Bureau of Standards shall be available to all state departments, municipal and private corporations and citizens of the state. The bureau shall be, for the state of Oklahoma, the highest official authority in regard to standards of weights, measures and tests, and methods of weighing, measuring and testing. The findings of the Bureau of Standards. in any case or question shall be considered prima facie evidence of the correctness thereof. All enforcing officers of weights, measures and tests legislation in the state of Oklahoma, shall submit their weighing, measuring, and testing devices to the State Bureau of Standards at such periods as set by the Board of Control for certification and seal. The Board of Control shall adopt a seal for this purpose. The Board of Control shal have authority to place any test or question referred to it to the proper individual or laboratory in the university.

Fees-Expenses.

Section 5. The Board of Control shall establish fees for all tests and certifications made by the bureau. The fees shall in no case exceed those established for similar work by the National Bureau of Standards. The fees shall be paid to the treasurer of the university and shall be disbursed by him upon the proper approval of the Board of Control. Fees shall be disbursed for meeting expenses of making tests and for equipAny fees unspent at the end of each biennium shall revert to the state.

Information Published.

Section 6. The bureau shall publish from time to time through the University of Oklahoma press for general distribution such literature and directions in regard to weights, measures and tests, and methods of weighing, measuring, and testing as deemed advisable by the Board of Control.

Report to Governor.

Section 7. The Board of Control shail report bi-ennially to the Governor of the state-this report to cover the details of all operations of the bureau during the biennium. It shall report to each Legislature, making such recommendations as it deem advisable with reference to proper legislation on weights, measures and tests and methods of weighing, measuring and testing.

CHAPTER 82.

APPROPRIATION-COLORED UNIVERSITY, LANGSTON-SCHOOL FOR BLIND, TAFT.

(HOUSE BILL No. 306.)

AN ACT making an appropriation for the support and maintenance of the Colored Agricultural and Normal University located at Langston, and for the support and maintenance of the Industrial Institute for Deaf, Blind and Orphans (colored), at Taft, for the fiscal years ending June 30th, 1916, and June 30th, 1917.

Be It Enacted by the People of the State of Oklahoma:

Appropriation-Maintenance and Repairs.

Section 1. There is hereby appropriated out of any money in the State Treasury not otherwise appropriated, the following sums, or so much thereof as may be necessary, for the support and maintenance, including improvements and repairs, of the Colored Agricultural and Normal University at Langston, and for the support and maintenance, including improvements, and repairs, of the Industrial Institute for Deaf, Blind and Orphans (colored) at Taft, for the fiscal years ending June 30, 1916, and June 30, 1917, as follows:

For the support and maintenance of the Colored Agricultural and Normal University at Langston for the year, 1916.

For the support and maintenance of the Colored Agricultural and Normal University at Langston for the year 1917– $15,650.

For the support and maintenance of the Industrial Institute for Deaf, Blind and Orphans (colored) at Taft for the year 1916-$25,666.

CHAPTER 83.

APPROPRIATION-MURRAY SCHOOL OF AGRICULTURE.
(HOUSE BILL No. 302.)

AN ACT making an appropriation for the support and maintenance of the Murray State School of Agriculture, at Tishomingo, Oklahoma, for the fiscal years ending June 30th, 1916, and June 30th, 1917.

Be It Enacted by the People of the State of Oklahoma:

Appropriation.

Section 1. There is hereby appropriated out of any moneys in the State Treasury, not otherwise appropriated, the sum of twenty-nine thousand and two hundred fifty dollars ($29,250.00) or so much thereof as may be necessary for the support and maintenance of the Murray State School of Agriculture, at Tishomingo, Oklahoma, for the fiscal years ending June 30, 1916, and June 30, 1917, said sum herein appropriated to be apportioned as follows:

For support and maintenance, including improvements and repairs, 1916, $15,250.00.

For support and maintenance, including improvements and repairs, 1917, $14,000.00.

CHAPTER 84.

SCHOOLS AND SCHOOL DISTRICTS-SUPPORT OF STATE SCHOOLS.

AN ACT providing for independent and common school districts where State schools are located, not maintaining a high school, to aid in support of said State school, providing how same shall be done.

Be It Enacted by the People of the State of Oklahoma:

Local Aid to State School-Per Capita Tax.
