CHAPTER 254.

APPROPRIATION-ELECTRIC CHAIR.

(HOUSE BILL No. 452.)

AN ACT for constructing and equipping electrocution apparatus for death chair, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Appropriation.

Section 1. There is hereby appropriated out of the treasury of the state of Oklahoma, from moneys not otherwise appropriated the sum of forty-five hundred ($4,500.00) dollars or so much thereof as may be necessary for constructing and equipping electrocution apparatus for death chair in the State Penitentiary at McAlester, Oklahoma.

Emergency.

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof it is necessary that this Act take effect and be in force from and after its passage and approval.

CHAPTER 255.

STATE AUDITOR-OFFICE AND EMPLOYEES.

(HOUSE BILL No. 456.)

AN ACT creating the officers and employes in the office of the State Auditor and fixing the salaries of such officers and employes and authorizing the State Auditor to appoint such officers and employes in the said State Auditor's office and providing for the keeping of a full and complete inventory of all property belonging to the state in said State Auditor's Office, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Officers and Salaries Created.

Section 1. The clerical and stenographical positions hereinafter named are hereby created and established in the office of

the State Auditor of the state of Oklahoma, and the salary or compensation of each shall be the amount following the name of such officer or position, payable monthly in the manner provided by law, as follows: Provided, that the State Auditor is hereby authorized and empowered to appoint when necessary and during his pleasure, persons to fill said positions as hereinafter

set out.

One assistant auditor at a salary of $2,000.00 per annum. One railway and public service corporation tax clerk at a salary of $1,800.00 per annum.

One assistant railway and public service corporation tax clerk at a salary of $1,500 per annum.

One gross revenue, gross production, income, inheritance, and graduated land tax clerk at a salary of $1,800.00 per annum. One assistant gross revenue, gross production, income, inheritance and graduated land tax clerk at a salary of $1,500 per

annum.

One stenographer to the tax department at a salary of $1,200 per annum.

One chief clerk to auditor at a salary of $1,500 per annum.
One warrant clerk and stenographer at a salary of $1,500 per

annum.

One bond clerk at a salary of $1,200 per annum.
One stenographer at a salary of $1,200 per annum.
One stenographer at a salary of $1,020 per annum.

One receiving and claim calendar clerk at a salary of $1,200 per annum.

One chief accountant at a salary of $2,000 per annum.
One assistant chief accountant at a salary of $1,800 per an-

One property accountant at a salary of $1,200 per annum.
One bookkeeper at a salary of $1,200 per annum.
One night watchman at a salary of $600 per annum.

Bonds of Officers.

Section 2. The State Auditor shall execute a bond payable to the state in the sum of fifty thousand dollars conditioned for the faithful performance of his duties, with some Surety Company authorized to do business in this state, as surety, which bond shall be approved by the Governor and filed in the office of the Secretary of State. Each of the employes in the office of

State Auditor, hereinafter named, shall execute a like bond in the sum of five thousand dollars, to be approved and filed in like manner as the bond of the Auditor, to-wit:

Assistant auditor, railway and public service corporation tax clerk, assistant railway and public service corporation tax clerk, gross revenue, gross production, income, inheritance and graduated land tax clerk, assistant gross revenue, gross production, income, inheritance and graduated land tax clerk, chief clerk to auditor, warrant clerk and stenographer, bond clerk, receiving and claim calendar clerk, chief accountant, assistant chief accountant, property accountant, bookkeeper. Provided that said auditor is hereby authorized and empowered to draw his warrant out of any contingent fund that may be appropriated for said department on the State Treasurer for such amount or amounts as is necessary to pay premiums on said bonds as set out above. Provided further, that the State Auditor is hereby authorized and it is hereby made his duty to keep in his office, a full and complete inventory of all property belonging to and owned by the state.

Repeal of Conflicting Acts.

Section 3. All acts or parts of acts in conflict with the provisions of this Act are hereby repealed.

Emergency.

Section 4. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist by reason whereof this Act shall take effect and be in force from and after its passage and approval.

CHAPTER 256.

POULTRY-COUNTY ENCOURAGEMENT.

(HOUSE BILL No. 510.)

AN ACT authorizing county commissioners to appropriate not to exceed one hundred dollars ($100.00) per year to encourage increased poultry production in the several counties of this state.

Be It Enacted by the People of the State of Oklahoma:

County May Encourage Poultry Production.

Section 1. The County Commissioners of the respective counties of this state may and they are hereby authorized and

empowered to appropriate and use any sum of money not to exceed one hundred ($100.00) dollars per year for the purpose of co-operating with the county branches for such respective counties of the Oklahoma State Poultry Federation in the work of increasing the poultry production in such respective counties, such money to be expended in each county under rules and regulations to be agreed upon by the County Commissioners thereof and the officers of the county branch of the Oklahoma State Poultry Federation in such county.

CHAPTER 257.

PUBLIC HEALTH-CREAMERY UTENSILS.

(HOUSE BILL No. 517.)

AN ACT providing for the sanitary handling of empty creamery and dairy containers.

Be It Enacted by the People of the State of Oklahoma:

Users to Cleanse Containers.

Section 1. It shall be the duty of every person, firm or corporation within this state, upon receiving from any creamery or dairy company, either by wholesale or retail, any creamery can, bucket, bottle, or any utensil used for conveyance of ice creams, sherbets, or frozen dainties, sweet milk, butter milk, sweet cream. and all products thereof, as soon as said creamery cans, buckets, bottles or utensils are empty, to thoroughly cleanse same with hot water at a temperature of not less than 180 degrees Fahrenheit. Such bottles shall be thoroughly drained, and such cans, containers and buckets shall be washed and thoroughly dried immediately upon emptying same.

Penalty.

Section 2. Any person, firm or corporation receiving such articles and upon failure to comply with all provisions of this Act shall be deemed guilty of a misdemeanor, and upon conviction, be fined not less than twenty-five- ($25.00) dollars nor more than fifty ($50.00) dollars for each and every offense.

How Enforced.

Section 3. It shall be the duty of the County Commissioner of Health and the County Dairy Commissioner and all other peace officers to enforce this Act.

CHAPTER 258.

FISH AND GAME-KILLING CERTAIN GAME.

(HOUSE BILL No. 589.)

AN ACT to amend chapter 59 of the Session Laws of 1913, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:
Prohibiting Hunting Deer, Bear, Turkey, Etc.

Section 1. That section 1,of chapter 59 of the Session Laws of the state of Oklahoma, 1913, be, and the same is hereby amended to read as follows:

"Section 1. It shall be unlawful for any person to hunt, chase, capture, shoot, shoot at, wound or kill any deer, bear, or wild turkey in the territory embraced in the counties of Comanche, Caddo, Kiowa, Major and Blaine."

Emergency.

Section 2. For the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof it is necessary that this Act take effect and be in force from and after its passage and approval.

CHAPTER 259.

SURETIES SEVERALLY LIABLE-PORTIONS OF OFFICIAL BOND.

(HOUSE BILL No. 604.)

AN ACT defining the liability of sureties on official bonds of less than the penal sum, repealing all acts and parts of acts in conflict herewith, and declaring an emergency.

Be It Enacted by the People of the State of Oklahoma:

Sureties May Be Liable in Part Only.

Section 1. When the penal sum of any bond required to be given for the faithful performance of the duties of any state, county or municipal officer or the appointee or employe of such officer amounts to more than one thousand dollars the sureties may become severally liable for portions of not less than five hundred dollars thereof, making in the aggregate at least two sureties for the whole penal sum. And if any such bond becomes forfeited, an action may be brought thereon against all or any
