SECTION 1. Certain acts

SECTION 2. The act of the twelfth of April, one thousand eight hundred and twenty-eight, and of the fourteenth day of April, one thousand eight hundred and twenty-eight, the first entitled "An act for the better regulation of the city of Lanof Assembly caster, and relative to the repair of public bridges in Lancaster repealed. county," and the second entitled "An act for the better regulation of the city of Lancaster, and relative to the repair of the public bridges in Lancaster county," passed the twelfth day of April, one thousand eight hundred and twenty eight, be and the same are hereby repealed, so far as the same relates to laying out roads, and assessing the damages occasioned by laying out the same, in the city of Lancaster: Provided, That all damages which have been sustained by the laying out of any streets, lanes, alleys or roads, under the provision of the above mentioned acts, and remain unpaid, shall be paid agreeably to the provisions of said acts.

AN ACT

For the relief of George Hess, Robert Peling, and Nicholas Neyfang, soldiers of the revolutionary war.

SECTION 1. It is enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the State Treasurer be, and he is hereby authorized and required to pay to George Hess, of Lebanon county, and to Robert Peling, of York county, soldiers of the revolutionary war, or to their respective orders, forty dollars to each immediately, and an annuity to each of forty dollars during life, payable half yearly, to commence on the first day of January, one thousand eight hundred and thirty-four.

SECTION 2. The State Treasurer is hereby authorized and required to pay to Nicholas Neyfang, of Schuylkill county, a soldier of the revolution, or to his order, a gratuity of forty dollars, in full for his revolutionary services.

For the relief of Henry Cristman, George Ruckle, Nathan James, and Robert Wright, soldiers, and Agnes Beck, the widow of a revolution ary soldier.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer be, and he is hereby authorized and required to pay to Henry Cristman and George Ruckle, of Northampton county, Nathan James, of Bucks county, and Robert Wright, of Cumberland county, soldiers of the revolu tion, or to their respective orders, forty dollars to each immediately, and an annuity of forty dollars to each during life, pay.

Preamble.

No. 41.

AN ACT

To authorize the Trustees of the First Presbyterian congregation in the eity of Philadelphia, to sell certain real estate.

WHEREAS, William Allison, and Grace his wife, by indenture, dated the eighteenth day of July, seventeen hundred and eighty-two, recorded at Philadelphia, in deed book number six, page one hundred and eighty-seven, &c., granted and conveyed unto John Caldwell, John Bleakley, William Ewing, Samuel Bryan, and William Allison, their heirs and assigns, a brick messuage and lot of ground, situate on the west side of Third street, from Delaware, between Spruce and Walnut streets, in the city of Philadelphia, containing in breadth, on Third street, eighteen feet, and in length or depth one hundred feet nine inches, or thereabouts, to hold the same in trust, to permit and suf fer the pastor or minister of the First Presbyterian congregation in said city, for the time being, to dwell in the said messuage, and to occupy the said lot of ground, if so inclined, free from any cost or charges of rent or taxes therefor; and in case the said pastor shall not incline to live therein, or occupy said lot, then with power to said trustees, to lease the same for a term of years not exceeding five years, and apply the rent for the support and maintenance of said pastor; which premises were paid for partly out of the proceeds of a legacy of five hundred pounds, bequeathed for the purpose of being applied, under the direction of a committee of said congregation, in buying a parsonage house for the benefit of the pastor thereof, and partly with the sum of two hundred pounds, raised by said

committee: AND WHEREAS, It is represented to the Legislature, that the said parsonage house is now and has been for many years unsuited to the residence of the pastor of said congrega. tion, in consequence of which the church has been compelled to rent another house for that purpose, and morcover to procure tenants, and pay taxes for the house in Third street; and that they have it now in their power to purchase another parsonage house in a convenient place, at a moderate price, and are desirous of disposing of the building conveyed by said deed, and investing the proceeds thereof in the parsonage house contemplated to be purchased: AND WHEREAS, It is represented that the said trustees are all deceased:

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That it shall and may be lawful for the trustees of the First Presbyterian congregation of the city of Philadelphia, to grant, bargain, and sell the messuage, lot and premises, described in the preamble, by public or private sale, to make, execute and acknowledge a good and sufficient deed of conveyance for the same to the purchaser or purchasers thereof, his, her, or their heirs and assigns, forever, in fee simple; discharged from the trust aforesaid, and to employ the money arising from said sale in the purchase of another parsonage house for the pastor of said church.
