RESOLUTION

Relative to the Clifford and Wilkesbatre turnpike.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the State Treasurer be hereby authorized to pay to the treasurer of the Clifford and Wilkesbarre turnpike road company, the unexpended balance of an appropriation made to that company, by an act of Assembly, of one thousand eight hundred and sixteen, as appears by the Auditor General's report of December, one thousand eight hundred and thirty-three, and that they apply the same on the road between Catlin's tavern and the Cocheston and Great Bend turnpike road, any thing in said act to the contrary notwithstanding.

RESOLUTION

For the relief of John Kelker, late deputy marshal of the eastern district of Pennsylvania.

WHEREAS by a resolution passed at the last session of the Legislature, and approved by the Governor of this Commonwealth on the ninth day of April, one thousand eight hundred Preamble. and thirty-three, John Kelker, late deputy marshal of the eastern district of Pennsylvania, was exonerated from the payment of a certain judgment obtained against him in the Circuit court for the county of Dauphin, at the suit of the said Commonwealth, but not from the payment of the costs of said suit: And whereas, The same principle on which the amount of the judg ment was released should extend to the costs, and as the practice has been established in the case of Isaac Griffith, late deputy marshal of Bucks county, by a resolution of the Legislature at their last session: Therefore,

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Auditor General be and he is hereby authorized to set

Relative to duty on foreign coal.

WHEREAS, an application is now pending in the Congress of the United States for the repeal or reduction of the duty on Nova Scotia and Liverpool coal: Therefore,

Resolved, That the Governor be requested to transmit a copy of the above resolution to each of our Senators and Representatives in Congress, as an expression of the opinion of the Legislature of Pennsylvania.

RESOLUTION

For the relief of Jacob Huggins of Perry county.

WHEREAS, Jacob Huggins, of the county of Perry, represents that he has sustained damage by the construction of the Pennwlvania canal through his land, which was not ascertained until the water was let into the same: And whereas, Under the act of ninth of April, one thousand eight hundred and twentyseven, an impression prevailed that the limitation contained in the eighth section, required that application should be made within one year after the completion of the work, on that part of the canal which runs through the land of the applicant, and under that impression the said Jacob Huggins did make appli. cation for viewers under that act, to the court of Quarter Sessions of said county, which court appointed viewers who view. ed his premises before the water was let into the canal, and before the damage sustained by him had been ascertained, and decided against him; and it is but right that the Commonwealth should do justice to every citizen: Therefore,

Relative to the public land at Erie.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, That the commissioners of the county of Erie, for the time be Commis'ers ing, be and they are herby authorized and empowered to take of Erie c'ty charge of the one hundred acres of land, granted by an act certain land, passed the eighth day of April, Anno Domini, one thousand eight hundred and thirty three, to the county of Erie, "for the use of a Poor House for said county," and that they have pow er until said property shall be required by the citizens of said county, for the purposes for which it was granted, to lease the same from year to year and apply the proceeds after all neces sary expenses are paid towards improving the said land and erecting suitable and proper buildings thereon.

RESOLUTION

To authorize the Commissioners of the Internal Improvement Fund to appropriate three hundred thousand dollars, of the loan under the act of the sixteenth of February, one thousand eight hundred and thirtythree, to the construction of the Canals and Rail Roads,

Resolved, by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Commissioners of the Internal Improvement Fund be authorized to apply three hundred thousand dollars of the bal ance of the loan, provided for by the act of Assembly of the sixteenth day of February, one thousand eight hundred and thirty-three, to the construction and repair of the canals and rail roads of this Commonwealth, agreeably to the provisiona

of an act, entitled "An act to continue the improvement of the State by Rail Roads and Canals," passed the fifth day of April, one thousand eight hundred and thirty-four, and to appropriate three hundred thousand dollars of the loan authorized by the act last aforesaid, to the purposes specified in the second section of the act passed on the day and year last aforesaid, entitled "An act to refund one hundred thousand dollars appropriated to repairs of Canals and Rail Roads, and to apply three hundred thousand dollars to the payment of loans.

Relative to a claim of the Commonwealth, against Christian Spayd, as river commissioner under the act of one thousand eight hundred and five, for improving the river Susquehanna.

Resolved by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, That the Auditor General be, and he is hereby authorized and required to settle the account of Christian Spayd, as river com- ized to settle missioner, under the act entitled "An act raising by way of the account of lottery, the sum of twenty thousand dollars, for removing the C. Spayd. obstructions and improving the navigation of the river Susquehanna and certain branches thereof," passed the eighteenth day of February, one thousand eight hundred and five, agreeably to a report of arbitrators, filed in the office of the court of Common Pleas of Dauphin county, on the seventeenth day of February, one thousand eight hundred and thirty-four, in a suit in the name of the Commonwealth of Pennsylvania, against Christian Spayd and the Auditor General is hereby authorized to enter satisfaction on said suit: Provided, That in his opinion no injustice will be done to the Commonwealth.
