The growing demand for information regarding the protection afforded to that species of industrial property known as “ designs,” “useful models," or “industrial models,” and the increasing number of applications filed, has led us to publish this little book for the use of our correspondents.

We expect, at another time, to give similar and more complete information with regard to the remaining foreign countries.

We suggest to Patent Solicitors that more attention be paid to the registration of designs. It should be an important and profitable branch of their business. The field is very broad, covering, as it does, the shape or form, and the surface configuration, of all the countless articles of manufacture and commerce in their varied forms. There is not a single article of commerce manufactured or sold that is not a proper subject for a design patent, provided there be novelty in its shape, or in its surface configuration. The subject of designs is receiving the attention it should have in the European countries. Instead of about 1,500 applications, as filed in the United States during the year 1896, 19,480 designs were registered in Great Britain during the year 1893; 22,255 in 1894, and 21,417 in 1895, the number of applications filed in other European countries also being relatively large.

It should be observed, too, that design protection may often be advantageously added to that obtained by mechanical patents, or the registration of trade marks. We would recommend that Solicitors file an application for a design patent (gebrauchmuster) in Germany, simultaneously with an application for mechanical patent, whenever there is any fear that the latter may be rejected. The government fee for the design application need not be paid, nor the design patent issued, until the mechanical application has been examined and finally granted or rejected. The cost of this proceeding will therefore be small, and if the mechanical application is rejected, valid protection will be secured by way of design patent.

The full text of the laws and regulations of the countries enumerated in this book can be found and examined in our office. We will also be glad to give any desired information with regard to either law or practice, in answer to specific inquiries, at any time, and without charge, and to render Solicitors any desired assistance in the preparation or prosecution of applications.
