Since the publication of the second edition of the present work, a considerable number of cases have been decided in England and America, which have an important bearing upon some of the topics discussed therein. I have availed myself of the present opportunity to revise the entire text, to correct such errors therein, as after a diligent examination, have met my notice, and to incorporate such of the recent authorities as may serve to illustrate, explain, confirm, or qualify the doctrines stated therein. In these respects I trust the reader will find the work substantially improved, at the same time, that I am conscious, so intricate and perplexed is the subject, and so various and confused are the materials, that the hope can scarcely be indulged, that it has attained entire completeness and accuracy.
