CONCURRENT RESOLUTIONS, 1903.

CONCURRENT RESOLUTION.

WHEREAS, The fiftieth anniversary of the beginning of work on the ship canal and locks at the falls of the St. Mary's River, between Lake Huron and Lake Superior occurs June fourth, nineteen-hundred three, and

WHEREAS, The construction of this waterway was one of the most important events of the nineteenth century in the development of the internal commerce of the United States, and

WHEREAS, The tonnage passing through the St. Mary's Canal shows it to be one of the most important waterways in the world, and it has, in its half century of history, proven one of the greatest aids to the great industrial development of the world, and it has contributed as much as anything to the growth and prosperity of the United States; therefore be it

Resolved by the Senate (the House concurring), That the Senate and House of Representatives of the State of Michigan hereby memorialize and petition the Congress of the United States to pass House joint resolution number one hundred forty four, now pending before that body, to provide for the commemoration of the semi-centennial anniversary of the commencement of the construction of the ship canal between Lake Huron and Lake Superior, at the falls of the St. Mary's River, in the State of Michigan, occuring June fourth, nineteen hundred three; and be if further

Resolved, That the Senators and Representatives in Congress, from the State of Michigan, be requested and urged to do everything in their power to secure the passage of this House joint resolution number onehundred forty-four; and be it further

Resolved, That copies of this resolution be sent to the Secretary of the Senate and the Clerk of the House of Representatives of the United States, and to the Senators and Representatives in congress from the State of Michigan; and be it further

Resolved, That the Governor of the State is hereby authorized and directed to extend in the name of the State of Michigan an invitation through the governors thereof to the other states bordering on the Great Lakes, namely-New York, Pennsylvania, Ohio, Indiana, Illinois, Wisconsin and Minnesota to appoint commissioners and to actively participate in the arrangements for and in carrying out of the plans of this celebration; this invitation to convey information of the action of the State of Michigan toward the proper celebration of this event. CONCURRENT RESOLUTION ordering advance payments under an appropriation made by a certain act.

WHEREAS, The following act passed at this session of the legislature, to wit: "An act to provide for the purchase for the State Law Library of the bound volumes of the records and briefs of the United States Supreme Court from the year eighteen hundred seventy-three to date" did not contain a proviso providing for advances and authorizing the Auditor General to draw his warrant thereunder prior to July one, nineteen hundred three, and charge the same to the appropriation when the same should become available; and

WHEREAS, It has been found expedient that such appropriation should be made available before said first day of July, nineteen hundred three; therefore

Resolved by the Senate (the House concurring), That the appropriation made by such act be and it is hereby made immediately available, and that all advances made thereunder be charged to the appropriation July one, nineteen hundred three.

CONCURRENT RESOLUTION directing the Commissioner of the State Land Office to convey by deed, to the township of Winterfield, Clare county, certain lands transferred to the state for delinquent taxes.

WHEREAS, The southeast quarter of southwest quarter of section twenty-eight in township twenty north, range six west, has been deeded to the state by the Auditor General under the provisions of law and is now held by the Commissioner of the State Land Office subject to sale or homestead entry; and

WHEREAS, Said description is not of value for agricultural purposes or for homestead entry, and has never been used or occupied except as a "gravel pit"; and

WHEREAS, The sole use and ownership of said land by the township of Winterfield would be of great benefit in providing gravel for the making and repairing of highways in said township and in the advantage of a large supply of gravel for years to come; now therefore

Resolved by the Senate (the House concurring), That the Commissioner of the State Land Office be and he is hereby authorized and directed to convey by deed to the supervisor of the township of Winterfield, Clare county, Michigan, and his successors in office, in trust for the sole use and benefit of said township, the southeast quarter of southwest quarter of section twenty-eight, township twenty north, range six west, in said county, for a consideration-one dollar.

CONCURRENT RESOLUTION for the sale of a right of way over certain lands in the townships of Arenac and Au Gres, in the county of Arenac, to the Detroit and Mackinac Railroad.

WHEREAS, The southeast quarter of the northeast quarter of section fourteen, the south half of the northwest quarter and the south half of the northeast quarter of section thirteen in township nineteen north of range five east, and the southwest quarter of the northeast quarter, the southeast quarter of the northwest quarter of section fourteen, the southwest quarter of the northwest quarter of section sixteen, the south half of the northwest quarter of section seventeen and the south half of the northeast quarter and the south half of the northwest quarter of section eighteen, in township nineteen north of range six east, in the townships of Arenac and Au Gres, in the county of Arenac, are now owned and held by the State as State homestead lands, and

WHEREAS, The east twelve acres of the southwest quarter of the northwest quarter of section fourteen, township nineteen north of range five east, and the south half of the northwest quarter and the south half of the northeast quarter of section fifteen in township nineteen north of range six east, said townships of Arenac and Au Gres, are held upon the books of the Auditor General as State tax lands, the taxes thereon being unpaid, and

WHEREAS The Detroit and Mackinac Railroad is desirous of constructing a railroad between the village of Omer in the township of Arenac and the village of Au Gres in the township of Au Gres, over and across the lands above described, and

WHEREAS, The construction of such railroad will be of great benefit to the State and will materially assist in developing the said townships; Resolved by the House (the Senate concurring), That the Commissioner of the State Land Office be and hereby is authorized to sell to said Detroit & Mackinac Railroad a right of way over and across the said State homestead lands one hundred feet wide, fifty feet on each side of its surveyed line for said railroad, for such price as he shall deem reasonable but not less than the minimum appraised value per acre of said land:

And the Auditor General be and hereby is authorized to sell to the said Detroit & Mackinac Railroad, a right of way over and across said State tax lands one hundred feet wide, fifty feet on each side of its surveyed line for said road, at a price not exceeding a pro rata per acre of the total amount due to the State in unpaid taxes on said lands.

This concurrent resolution is ordered to take immediate effect.

CONCURRENT RESOLUTION ordering advance payments under an appropriation made by a certain act.

WHEREAS, The following act passed at this session of the legislature, to wit: "An act to provide for expenses necessary to furnish official information from the records of the Adjutant General's office, for which no provision is made, pertaining to the enlistment, muster, history and final disposition of the soldiers and sailors from this State during the War of the Rebellion and Spanish-American war, to furnish certificates of service to applicants where the soldiers muster out or discharge papers are lost, and to furnish such information from the records of the office as to establish the soldier's or sailor's military or naval history and to make an appropriation therefor, and to provide for a tax to meet the same," did not contain a proviso permitting advances and authorizing the Auditor General to draw his warrant thereunder prior to July first, nineteen hundred three, and charge the same to the appropriation when it should become available, and

WHEREAS, It has been found expedient that such appropriation should be made available before said first day of July, nineteen hundred three; therefore

Resolved, by the House (the Senate concurring) that the appropriation made by such act be and it is hereby made immediately available, and that all advances made thereunder be charged to the appropriation July first, nineteen hundred three.

CONCURRENT RESOLUTION ordering a certain act to take immediate effect.

WHEREAS, The following act passed at the present session of the legislature, to-wit: House bill number seven hundred forty-three (Senate file number one hundred ninety-nine), entitled "An act to provide a tax to meet the amounts disbursed by the State for the current expenses of the Michigan State Prison, the State House of Correction and Branch Prison, Upper Peninsula, and the Michigan Reformatory;" was not ordered to take immediate effect; and

WHEREAS, It has been found expedient that such act should be ordered to take immediate effect, therefore

Resolved by the Senate (the House concurring), That such act be and it is hereby ordered to take immediate effect.

CONCURRENT RESOLUTION authorizing the Auditor General to audit vouchers for disbursements made by the State Industrial Home for Girls for current expenses of the fiscal year ending June thirty, nineteen hundred three, and charge the same to the appropriation made by act number one hundred twenty-two, public acts of nineteen hundred three, approved May fourteen, nineteen hundred three, for current expenses of the fiscal year ending June thirty, nineteen hundred four.

WHEREAS, It appears that owing to the advance in prices of supplies the amount appropriated for current expenses of the State Industrial Home for Girls for the year ending June thirty, nineteen hundred three, is exhausted for the first eleven months' expenses of the fiscal year endnig June thirty, nineteen hundred three; and

WHEREAS, The board of guardians of the said home believe that by strict economy the appropriation made by act number one hundred twenty-two of the public acts of nineteen hundred three, for current expenses of the fiscal year ending June thirty, nineteen hundred four, will be sufficient to meet the expenses for that year and the deficiency in the appropriation for current expenses for the fiscal year ending June thirty, nineteen hundred three; therefore

Resolved by the House (the Senate concurring), That the Auditor General be authorized to audit vouchers in payment of purchases for the running expenses of the State Industrial Home for Girls for the fiscal year ending June thirty, nineteen hundred three, in excess of the amount of the current expense appropriation for that year and charge the same to the appropriation made by act number one hundred twenty-two, public acts of nineteen hundred three, for current expenses for the fiscal year ending June thirty, nineteen hundred four.

This resolution is ordered to take immediate effect.
