CHAPTER 9.

An Act to amend The Dower Act.

(Assented to April 8, 1926.)

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta,

enacts as follows:

1. This Act may be cited as "The Dower Act Amendment Short title Act, 1926."

2. The Dower Act, being chapter 135 of the Revised Section 2 (a) Statutes of Alberta, 1922, is amended as to paragraph (a) of section 2 by adding thereto the words "and shall include every mortgage by deposit of certificate of title or other mortgage not requiring the execution of any document."

3. Section 3 of the said Act is amended by striking out Section 3 the words "in so far as it may affect the interest of the said wife in such homestead under this Act" where they occur therein.

4. Section 4 of the said Act is amended by adding as sub- Section 4 (3) sections (3) and (4) thereof the following:

"(3) In this section 'homestead' shall include the personal property of the deceased husband declared in The Exemptions Act to be free from seizure under a writ of execution in his lifetime, and the life estate hereinbefore declared to be vested in the wife shall include a right to use the said property.

"(4) In the event of any dispute arising as to what articles are included in the preceding section, the question shall be submitted to a judge of the judicial district in which the homestead lies, who shall summarily decide the same."

5. This Act shall come into force on Proclamation of the Date of Lieutenant Governor in Council.

CHAPTER 10.

An Act to amend The Alberta Evidence Act.

HIS

(Assented to April 8, 1926.)

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

1. This Act may be cited as "The Alberta Evidence Act Short title Amendment Act, 1926."

2. The Alberta Evidence Act, being chapter 87 of the Revised Statutes of Alberta, 1922, is amended by adding as section 33a thereof, the following:

"33a. Every certificate or extract from a record used Certificates, by any weighmaster or grain inspecting officer under the master, etc. provisions of The Canada Grain Act, being chapter 33 of the Statutes of Canada for 1925, signed and sealed as provided by the said Act, shall, without proof of the seal thereon, or of the signature or official character of the person or persons appearing to have signed the same, be prima facie evidence of the facts stated therein."

3. This Act shall come into force on the day upon which Coming into
