CHAPTER 21.

An Act to amend The Alberta Pharmaceutical
Association Act.

(Assented to April 8, 1926.)

HIS

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta,

enacts as follows:

1. This Act may be cited as "The Alberta Pharmaceutical Short title Association Act Amendment Act, 1926."

2. The Alberta Pharmaceutical Association Act, being Section 18a chapter 203 of the Revised Statutes of Alberta, 1922, is amended by adding as section 18a the following: “18a.—(1) The council may by resolution declare that Discipline re proceedings any person is, in the opinion of the council, unfit to be a member of the association, in consequence of his conviction for an offence against an Act of the Parliament of Canada or of the Legislative Assembly of Alberta and if any member of the Alberta Pharmaceutical Association after due inquiry by the council is adjudged by them to have been guilty of infamous or unprofessional conduct in any respect or of professional incompetence, negligence or misconduct, so gross as to disqualify such person in the opinion of the council from practising under this Act, the council may, if they see fit, direct the registrar to erase the name of such person from the register.

“(2) When the council has so removed the name of a person from the register, the name of that person shall not again be entered thereupon, except under authority of a resolution of the council or of an order of a judge of the Supreme Court.

"(3) A person whose name has been directed to be erased from the register may appeal from the decision of the council to a judge of the District Court, any time within six months after the date of the order and a judge may, upon hearing the appeal, make such order as to the restoration of the name so erased or confirming such erasure or for further inquiries by the council into the facts of the case and as to costs as shall be just.

"(4) The appeal may be by motion, notice of which shall be served upon the registrar and the registrar shall, upon the request of any person desiring to appeal, furnish to such

person a certified copy of all proceedings, reports, orders and papers upon which the council has acted in making the order complained of.

"(5) No action shall lie against the council or its members for any proceedings taken or judgments given or in force under the provisions of this Act."

3. Section 24 of the said Act is amended

(a) as to subsection (1) by adding in paragraph (b) thereof after the word "has" where it occurs in the second line the words "before attending lectures as hereinafter required."

(b) by striking out in subsection (3) all the words after the words "University of Alberta" where they occur in the sixth line, and substituting therefor the following: "shall be registered upon producing evidence that he has served twenty-four months in the actual practice of pharmacy in the drug store of a duly registered pharmaceutical chemist bona fide carrying on business as such, and that twelve months of such apprenticeship have been served prior to entering upon such course."

4. Section 33 of the said Act is hereby struck out and the following substituted therefor:

"33. Nothing in this Act shall prevent any person in any place, who has received a permit so to do from any member of the Alberta Provincial Police force, from selling strychnine or other poison for the destruction of gophers to a resident of the Province; provided such poison is sold in packages labelled with the name of the article and the word 'Poison'; and provided further that the seller shall make an entry in a book to be kept for that purpose, stating the date of the sale, the name and address of the purchaser, the name and quantity of the article sold and the purpose for which it was stated by the purchaser to be required, to which entry the signature of the purchaser shall be affixed."

5. This Act shall come into force on the day upon which it is assented to.

CHAPTER 22.

An Act to amend The Optometry Act.

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta,

enacts as follows:

1. This Act may be cited as "The Optometry Act Amend- Short title ment Act, 1926."

2. The Optometry Act, being chapter 77 of the Statutes Section of Alberta, 1921, is amended as to section 10 thereof by 10 (3) added adding thereto as subsection (3) the following:

"(3) A certificate under the hand of the Registrar of the Association to the effect that any person is or is not registered under this Act, shall be prima facie evidence of such fact, without proof of the signature on such certificate, and without proof of the fact that the person signing the same occupies the position of Registrar of the Association."

3. This Act shall come into force on the day upon which Coming into it is assented to.

CHAPTER 23.

An Act to amend The Venereal Diseases' Prevention

Act.

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta,

enacts as follows:

1. This Act may be cited as "The Venereal Diseases' Short title Prevention Act Amendment Act, 1926."

(1) (a)

2. The Venereal Diseases' Prevention Act, being chapter Section 3a 61 of the Revised Statutes of Alberta, 1922, is amended as substituted to subsection (1) of section 3a by striking out paragraph (a) thereof and substituting therefor the following: "(a) If any person is under arrest or in custody on a charge of any offence against section 216 of The Criminal Code (procuring-living on earnings of prostitution) or of keeping a common bawdy house under section 228 of the same or of being found in a common bawdy house under section 229 of the same or of being an inmate of a common bawdy house under section 229a of the same or of being a loose, idle or disorderly person or vagrant under section 238i and 239 of the same (common prostitute or nightwalker) or under sections 2381 and 239 of the same (living on the avails of prostitution) then the justice shall order that such person shall be physically examined by a medical practitioner appointed by the Provincial Board of Health and in the manner and to the extent prescribed by the regulations and at such place as may be directed by the justice."

3. Section 3a of the said Act is amended as to subsection Section 3a (2) thereof by striking out the word "section" and insert- (2) amended ing in lieu thereof the word "subsection."

4. This Act shall come into force on the day upon which Date of it is assented to.
