In an opinion handed down April 5, 1906, the state Supreme court declared the Illinois primary law enacted in 1905 unconstitutional on the grounds that it contained provisions delegating legislative functions to political organizations, required the payment of fees by candidates for office, set up a geographical qualification for candidates for the legislature and made out one set of requirements for one part of the state and another set for another part. Gov. Deneen, on the same day, issued a call for an extra session of the legislature for the purpose of enacting a new primary law. The session began April 10 and ended May 16. The primary law then passed was also declared unconstitutional in a decision made public Oct. 2, 1907. Dolden contained more than the title specified, the title wholly failing to provide for a primary election for the purpose of selecting candidates for office; because the lodging of legislative power with county or central committees or other purely voluntary party organizations is unconstitutional; because the method provided for filling vacancies is in direct conflict with section 188 of the bill of rights, providing that all elections shall be free and equal; because the act provided no means by which a person might register for the primary election if for any reason he had failed to register at the last general election, and because the act provided that a voter could vote for only one candidate for representative in the general assembly. Section 14 of the act of 1872 as amended in 1897 and 1901 declares: "The wages for services of a wage earner who is the head of a family and residing with the same, to the amount of fifteen (15) dollars per week, shall be exempt from garnishment. All above the sum of fifteen (15) *Served only fifteen days, completing Reynolds' term. Died in office; succeeded by John Wood. Democrat after 1872.
