Petition No. 595. By Mr. Kingman: Protest of Ned R. Smith and 25 other citizens of Calhoun county, against the passage of the Fitzgibbon bill, providing for the submission of the local option question to the village, township and city as a unit, instead of to the county as under the present law.

The protest was referred to the Committee on Liquor Traffic.

Petition No. 596. By Mr. Fowle: Petition of Alfred Nelson and 27 other citizens of Wallace, in favor of the passage of the two cent fare bill.

The petition was referred to the Committee on Railroads.

Petition No. 597. By Mr. Taylor: Resolutions of the Common Council of Three Rivers, in favor of the passage of the so-called home rule bill.

MOTIONS AND RESOLUTIONS.

Mr. James moved to take from the table

House bill No. 78 (file No. 177), entitled

A bill to provide a tax to meet the amounts disbursed by the State for the current expenses of the Michigan State Prison, the State House of Correction and Branch Prison in the Upper Peninsula and the Michigan Reformatory.

The motion prevailed.

The bill having been passed,

Mr. James moved that the bill be ordered to take immediate effect.
The motion prevailed, two-thirds of the Senators-elect voting therefor.

Mr. James moved that a respectful message be sent to the House, asking the return to the Senate of

House bill No. 46 (file No. 42), entitled

A bill for the prevention of fire waste, and the creation of the office and appointment of a State fire marshal, for the appointment of his assistants, to prescribe the duties, powers and authority of each, to fix the salaries for the same and to provide for salaries and necessary expenses. The motion prevailed.

Mr. Moriarty moved that when the Senate adjourns today, it stand adjourned until tomorrow at 10 o'clock a. m.

Mr. White moved to take from the table

Senate bill No. 184 (file No. 172), entitled

A bill to authorize and direct the Board of State Tax Commissioners to investigate, examine into, inventory and appraise all mining properties and mineral rights in the State of Michigan and to define their powers and duties in relation thereto, and to report the result of their investigation, examination, inventory and appraisal to the State Board of Equalization on or before the third Monday of August in the year 1911, and to make an appropriation therefor, and to provide a penalty for the violation of this act.

The motion prevailed.

The question being on concurring in the amendments made to the bill by the House,

The Senate did not concur, a majority of the Senators-elect not voting therefor, by yeas and nays, as follows:

Resolved, That the Senate purchase the group picture now on exhibition by Photographer Ellison, and that the Secretary of the Senate be and he is hereby directed to draw an order for the price thereof, $58.50, payable to said photographer.

Pending the reference of the resolution to a committee, under the last clause of Rule 17,

Mr. Moriarty moved that the rule be suspended and that the resolution be placed on its immediate consideration.

The motion prevailed, two-thirds of the Senators present voting therefor.

A bill to amend sections 8 and 17, and add a new section to be known as section 40 of Act No. 313 of the Public Acts of 1887, entitled "An act to provide for the taxation and regulation of the business of manufacturing, selling, keeping for sale, furnishing, giving or delivering spirituous and intoxicating liquors, and malt, brewed or fermented liquors and vinous liquors in this State, and to repeal all acts or parts of acts inconsistent with the provisions of this act," as amended by Act No. 291 of the Public Acts of 1909, entitled "An act to amend the title and sections 1, 2, 4, 5, 6, 7, 8 and 17 of Act No. 313 of the Public Acts of 1887; entitled 'An act to provide for the taxation and regulation of the business of manufacturing, selling, keeping for sale, furnishing, giving or delivering spirituous and intoxicating liquors, and malt, brewed or fermented liquors and vinous liquors in this State, and to repeal all acts or parts of acts inconsistent with the provisions of this act,' as amended, said sections being compiler's sections 5379, 5380, 5382, 5383, 5384, 5385, 5386 and 5395 of the Compiled Laws of 1897, and to further amend said act by adding five new sections thereto to stand as sections 35, 36, 37, 38 and 39;"

With the following amendments thereto:

1. By inserting at the end of line 59 of section 8, the following: "The township board of any township, the board of trustees of any village. or the common council of any city may, by a majority vote, reject any or all such bonds presented to them for their approval."

2. By inserting in line 25 of section 17 after the third word "day" the words "New Years day."

Recommend that the amendments be concurred in, and that when so amended the bill pass.
