Petition No. 608. By Mr. Fowle: Petition of A. C. Lange and 180 other citizens of Sault Ste. Marie, in favor of the passage of the bill providing for two cent fares on the railroads of the Upper Peninsula. The petition was referred to the Committee on Railroads.

Senate bill No. 415 (file No. 391), entitled

A bill to amend section 12 of Act No. 232 of the Public Acts of 1903, entitled "An act to revise and consolidate the laws providing for the incorporation of manufacturing and mercantile companies, or any union of the two, and for the incorporation of companies for carrying on any other lawful business, excepting such as are precluded from organization under this act by its express provisions, and to prescribe the powers and fix the duties and liabilities of such corporations," as amended by Act No. 194 of the Public Acts of 1905, and as further amended by Act No. 137 of the Public Acts of 1907;

Was read a third time and passed, a majority of the Senators-elect voting therefor, by yeas and nays, as follows:

Mr. Cartier moved that the bill be ordered to take immediate effect for the reason that the bill comes under the provisions of section 21 of Article V of the Constitution of the State of Michigan, which provides "that the Legislature may give immediate effect to acts immediately necessary for the preservation of the public peace, health and safety." The motion prevailed and the bill was ordered to take immediate effect, two-thirds of the Senators-elect voting therefor.

Senators Moriarty, F. D. Scott and Snell entered the Senate Chamber and took their seats.

Mr. Mapes moved that the Senate resolve itself into the committee of the whole on the

After some time spent therein, the committee rose, and through its chairman made the following report:

The committee has had under consideration the following:
Senate bill No. 432 (file No. 409), entitled

A bill to amend section 7 of Act No. 81 of the Laws of 1873, entitled "An act to establish a State Board of Health; to provide for the appointment of a superintendent of vital statistics, and to assign certain duties to local boards of health," being section 4403 of the Compiled Laws of 1897, as amended by Act No. 18 of the Public Acts of 1905; Also:

Senate bill No. 75 (file No. 64), entitled

A bill making appropriations for the State Tuberculosis Sanatorium for current expenses and for building and special purposes for the fiscal years ending June 30, 1912, and June 30, 1913, and to provide a tax to meet the same;

Also:

Senate bill No. 170 (file No. 159), entitled

A bill making appropriations for the Northern Michigan Asylum for the Insane for building and special purposes for the fiscal year ending June 30, 1912;

Also:

Senate bill No. 316 (file No. 406), entitled

A bill to provide for the inspection of commercial feeding stuffs and to regulate the sale thereof;

Has made no amendments thereto, and has directed its chairman to report the same back to the Senate, and recommend their passage.

The committee of the whole has also had under consideration the following:

Senate bill No. 223 (file No. 211), entitled

A bill to amend section 15 of Act No. 207 of the Public Acts of 1889, entitled "An act to prohibit the manufacture, sale, keeping for sale, giving away or furnishing of vinous, malt, brewed, fermented, spirituous or intoxicating liquors, or any mixed liquors or beverages, any part of which is intoxicating, and to prohibit the keeping of any saloon or other place for the manufacture, sale, storing for sale, giving away

or furnishing of such liquors or beverages, and to suspend the general laws of the State relative to the taxation and regulation of the manufacture and sale of such liquors in the several counties of this State under certain circumstances; to authorize the qualified electors of the several counties in this State to express their will in regard to such prohibition by an election, and to authorize and empower the boards of supervisors of the several counties, after such election, if they shall determine the result to be in favor of such prohibition, to prohibit the manufacture, sale, keeping for sale, giving away or furnishing of the same within their respective counties; and to provide for penalties and rights of action in case of its violation," the same being section 5426 of the Compiled Laws of 1897, as last amended by Act No. 170 of the Public Acts of 1903.

Has amended the same as follows:

By adding to section 15 the following:

"And be it further provided, That no new breweries shall be built, established or put in operation in any county which has adopted local option."

Senate bill No. 430 (file No. 407), entitled

A bill to authorize and instruct the State Treasurer to pay to

widow of William T. Densmore, the sum of two hundred ninety dollars, being the amount remaining in the State treasury unclaimed under joint resolution No. 7, of the Regular Session of 1899; Has amended the same as follows:

1. By inserting in line 26 of the preamble after the word "the" the word "twenty-seven."

2. By inserting in line 27 of the preamble after the word "of" the word "July."

3. By inserting in line 27 of the preamble after the word "hundred” the word "ten."

4. By inserting in line 31 of the preamble after the word "Said" the words "Mrs. William T. Densmore."

5. By inserting in line 2 of section 1 after the words "pay to" the words "Mrs. William T. Densmore."

And has directed its chairman to report the same back to the Senate, asking that the amendments be concurred in, and recommend that, as amended, the bills pass.

The committee of the whole has also had under consideration the following:

Senate bill No. 355 (file No. 328), entitled

A bill to prescribe the form and manner of service and the cancellation of notices required under the general liquor laws of this State, forbid ding the giving away, selling or delivering of malt, brewed, fermented or vinous liquors to certain persons;

Has amended the same as follows:

1. By inserting in line 7 of section 1 after the word "Village" the words "prosecuting attorney, sheriff."

2. By striking out of line 9 of section 1 the words "and a photograph."

And has directed its chairman to report the same back to the Senate, asking that the amendments be concurred in but not having gone through therewith, has directed its chairman to report progress thereon and asks leave to sit again for the further consideration of the bill.

The committee of the whole has also had under consideration the following:

Senate bill No. 197 (file No. 186), entitled

A bill to amend section 1 of Act No. 122 of the Public Acts of 1905, entitled “An act to define and to protect fishing rights and privileges in that portion of Saginaw Bay bordering on Arenac and Iosco counties, State of Michigan," approved May 17, 1905;

Has directed its chairman to report the same back to the Senate, with the recommendation that all after the enacting clause of the bill be stricken out.

The report was accepted.

The Senate concurred in the recommendation of the committee regarding the first, second, third and fourth named bills in the report and the bills were placed on the order of third reading of bills.

The Senate concurred in the amendments made to fifth and sixth named bills in the report and the bills were placed on the order of third reading of bills.

The Senate concurred in the amendments made to the seventh named bill in the report and the Senate granted the committee leave to sit again for the further consideration of the bill.

The Senate concurred in the recommendation of the committee regarding the eighth named bill in the report and all after the enacting clause of the bill was stricken out.

Your Petitioner, Joseph W. Donovan, respectfully represents unto your Honorable body, that at the election held in the county of Wayne and State of Michigan, on the 3rd day of April, A. D. 1911, he was a candidate for the office of Circuit Judge; that he had previously been nominated for said office by the Republican party at the primaries held on the 1st day of March, A. D. 1911; that at said election there were six (6) Republican candidates for said Circuit Judgeship, and that there
