Sir—I am instructed by the House to transmit the following bill:
House bill No. 284 (file No. 248), By Mr. Gee, entitled

A bill to amend sections 4 and 5 of Act No. 108, Session Laws of 1895, entitled "An Act to prevent the spreading of bush, vine and fruit tree pests, such as canker-worm and other insects, and fungus and contagious diseases, and to provide for their extirpation," as amended by Act No. 2, Session Laws of 1897;

Which has passed the House by a majority vote of all the members elect, and in which the concurrence of the Senate is respectfully asked. Very respectfully,

A bill to amend sections 5 and 7 of chapter 11 of an Act, entitled "An Act to provide a charter for the City of Detroit, and to repeal all Acts and parts of Acts in conflict therewith," approved June 7, 1883;

Which has passed the House by a majority vote of all the members elect, and by a vote of two-thirds of all the members elect been ordered to take immediate effect, and in which the concurrence of the Senate is respectfully asked.

The bill was read a first and second time by its title and referred to the Committee on Cities and Villages.

Mr. Loomis moved that the Senate resolve itself into the committee of the whole on the

GENERAL ORDER.

The motion prevailed.

After some time spent therein the committee rose and, through their chairman, made the following report:

House bill No. 485 (file No. 286), entitled

A bill making appropriations for the Michigan Home for the Feeble Minded and Epileptic for the fiscal years ending June 30, 1902, and June 30, 1903, and to provide for a tax to meet the same;

Also:

House bill No. 1196 (file No. 249), entitled

A bill to amend section 1 of Act No. 45 of the Public Acts of 1887, entitled "An Act to facilitate the disposal and settlement of taxes on vacant or part-paid swamp, school and other lands," approved March 24, 1887, as amended by Act No. 69 of the Session Laws of 1889, the same being section 3978 of Compiled Laws of 1897;

Also:

House bill No. 535 (file No. 285), entitled

A bill making appropriations for the Eastern Michigan Asylum for the fiscal year ending June 30, 1902, for the purpose of purchasing lands for the use and benefit of said asylum, and to provide for a tax to meet the same;

Also:

House bill No. 14, entitled

A bill to determine the duties and fix the compensation of the Secretary of the Senate and the Clerk of the House of Representatives; Also:

House joint resolution No. 1101, entitled

A joint resolution authorizing the Board of State Auditors to erect a stone base and place thereon a stone castle made by the First Regiment Michigan Engineers and Mechanics, the same to be placed on the Capitol grounds and to provide for the payment of the same;

Have made no amendments thereto, and have directed their chairman to report the same back to the Senate, and recommend their passage.

The committee of the whole have also had under consideration the following:

House bill No. 189 (file No. 261), entitled

A bill making an appropriation for the use of the State Board of Health for general purposes for the promotion of the public health for the fiscal year ending June 30, 1902, and each fiscal year thereafter, and to provide for a tax to meet the same;

And have directed their chairman to report the same back to the Senate with the recommendation that it be laid on the table.

The report was accepted.

The bills and joint resolution named in part I of the report were placed on the order of Third Reading of Bills.

Mr. McMullen moved that the Senate concur in the recommendation of the committee regarding the bill named in part II of the report, and that the same be laid on the table.

Mr. Loomis demanded the yeas and nays.

The motion made by Mr. McMullen then prevailed, a majority of all the Senators present voting therefor, by yeas and nays, as follows:

Senate bill No. 4 (file No. 173), entitled A bill to amend section 8 of Act No. 206 of the Session Laws of 1893, entitled "An Act to provide for the assessment of property and the levy (and collection) of taxes thereon, and for the collection of taxes heretofore and hereafter levied; making such taxes a lien on the lands taxed, establishing and continuing such lien, providing for the sale and conveyance of lands delinquent for taxes, and for the inspection and disposition of lands bid off to the State and not redeemed or purchased; and to repeal Act No. 200 of the Public Acts of 1891, and all other Acts and parts of Acts in anywise contravening any of the provisions of this Act;"

Was read a third time and passed, a majority of all the Senators elect voting therefor, by yeas and nays, as follows:

A bill to authorize the Commissioner of the State Land Office to cause a survey of the islands in the lake situated in section 16, township 58

north, range 37 west, to be made, and to provide for the payment of the necessary expenses incurred thereby;

Was read a third time and, pending the taking of the vote on the passage thereof,

Mr. Charles Smith moved to amend the bill by inserting in line 4 of section 1 after the word "west" the words "in the lakes known as Muskrat Lake and Section Ten Lake, situated in township 22 north, range 8 west, and the lakes known as Crooked Lake and Goose Lake, situated in township 23 north, range 8 west."

The amendment was received, a majority of all the Senators elect voting therefor.

The amendment was then adopted.

The question being on the passage of the bill, as amended,

The question being on agreeing to the title,

Mr. Charles Smith moved to amend the title so as to read as follows: A bill to authorize the Commissioner of the State Land Office to cause a survey of the islands in the lake situated in section 16, township 58 north, range 37 west, in the lakes known as Muskrat Lake and Section Ten Lake, situated in township 22 north, range 8 west, and the lakes known as Crooked Lake and Goose Lake, situated in township 23 north, range 8 west, to be made, and to provide for the payment of the necessary expenses incurred thereby.

The motion prevailed, and the title was so amended.

The title, as amended, was then agreed to.

House joint resolution No. 1101, entitled

A joint resolution authorizing the Board of State Auditors to erect a stone base and place thereon a stone castle made by the First Regiment Michigan Engineers and Mechanics, the same to be placed on the Capitol grounds and to provide for the payment of the same;

Was read a third time by its title and, pending the further reading of the joint resolution,

Mr. Kelly moved that the joint resolution be referred to the Committee on State Affairs.

The motion prevailed.

A bill to determine the duties and fix the compensation of the Secretary of the Senate and the Clerk of the House of Representatives; Was read a third time and passed, a majority of all the Senators elect voting therefor, by yeas and nays, as follows:

Mr. Moore moved to reconsider the vote by which the Senate refused to order the above named bill to take immediate effect.

The motion prevailed.

The question being on the motion that the bill be given immediate effect,
