Mr. Goodell moved that Rule 12 be suspended during the Executive Session.

The motion prevailed, two-thirds of all the Senators present voting therefor.

Mr. Atwood moved to suspend Rule 36, limiting the time within which a motion to reconsider a vote may be made.

The motion prevailed, two-thirds of all the Senators elect voting therefor.

Mr. Atwood moved to reconsider the vote by which the Senate advised and consented to the following nomination to office by the Governor:

James B. Kennedy, of Detroit, as member of the Board of Health of the City of Detroit.

The motion prevailed.

Mr. Atwood moved that the foregoing nomination be referred to the Governor for correction.

The motion prevailed.

MESSAGES FROM THE GOVERNOR.

The following message from the Governor was received and read:

To the President of the Senate:

I hereby nominate Johnston B. Kennedy, of Detroit, as member of the Board of Health of the City of Detroit to fill the unexpired portion of the term ending the first day of March, 1902.

The question being on the reference of the message to the Committee on Executive Business,

Mr. Atwood moved that the rules be suspended and that the Senate proceed to vote upon the question of advising and consenting to the foregoing nomination to office.

The motion prevailed, two-thirds of all the Senators present voting therefor.

The Senate then advised and consented to the foregoing nomination to office, by yeas and nays, as follows:

Mr. Murfin moved that the rules be suspended and that the Senatę proceed to vote on the question of advising and consenting to the foregoing nomination to office.

William T. Dust, of Detroit, Wayne county, as member of the Board of State Tax Commissioners for the unexpired portion of the term ending the 31st day of December, 1904;

Respectfully report that they have had the same under consideration, and have directed me to report the same back to the Senate without recommendation.

The report was accepted.

The motion prevailed, the time being 2:55 o'clock p. m.
