Board of elections, number and terms. be eligible as a member of said board of elections, and all votes cast at any general election or special election for any person who shall have, during any portion of the three months previous to any such election, served as a member of said board of elections for any office, shall be absolutely void. The members of said board of elections shall hold office for the period of four years from the first day of May, eighteen hundred and seventy-three, and until their successors shall be appointed. [By ch. 528, 1880, the term of office of the present board of elections is extended until May 1, 1885, and until their successors are appointed. See secs. 528-530, post.] Such appointment shall be made in the same manner and during the thirty days previous to the expiration of the said term of office. And in case of the resignation or death of any member of said board, his successor shall, within thirty days after such resignation or death, be appointed for the remainder of his term in the same manner as he was appointed. The said board shall have power to appoint one of its members president of said board, and each member of the said board shall be paid for his services at the rate of one thousand dollars a year. Said board shall have power to appoint a clerk and to remove him from such office, and said clerk shall receive such salary as shall be fixed by said board, at a rate not exceeding two thousand dollars a year; and said board shall have power to secure such room or rooms, and to employ such other assistants as may be necessary for the transaction of their business. 4, ch. 575, 1872, as amended by § 4, ch. 365, 1873. Board of elections, number and terms. SEC. 528. Immediately after the passage of this act, the comptroller of the city of Brooklyn shall appoint an additional member of the board of elections of the city of Brooklyn, who shall be of the same political party as the present minority member of said board, which said member, together with the present members of the board of elections of the city of Brooklyn, shall constitute the board of elections of the city of Brooklyn for the term of five years from the first day of May, eighteen hundred and eighty, and until their successors are appointed and shall have qualified. § 1, ch. 528, 1880, entitled "An act to provide for the appointment of a board of elections and of registers, canvassers, inspectors and poll-clerks in the city of Brooklyn, and to fix their compensation." Passed May 31, 1880; three-fifths being present. Board of elections, term of office, vacancies, powers, and salary. elections, office, powers, SEC. 529. The term of office of the present members Board of of the board of elections is hereby extended to May first, term of eighteen hundred and eighty-five, and they shall hold vacancies, office until their successors are appointed; and the term and salary. of office of any member of the board of elections appointed under this act shall be five years, and he shall also hold office until his successor shall be appointed and shall have qualified; such appointment shall be made in the manner herein set forth; and during thirty days previous to the expiration of the said term of office, and in case of the removal, resignation or death of any member of said board, his successor shall, within thirty days after such removal, resignation or death, be appointed by the mayor of the city of Brooklyn for the remainder of the term; and the person so appointed shall be of like political faith and opinion with the member whose vacancy is to be filled. The said board shall have the power to appoint, or, in case the members cannot agree, select by lot one of its members president of said board, and each member of said board shall be paid for his services at the rate of one thousand dollars a year. The two members of said board of like political faith and opinions shall have power to appoint a clerk and to remove him from office; and the remaining two members shall have power to appoint another clerk and remove him from office. And said clerks shall each receive a salary to be fixed by such board at a rate not exceeding fifteen hundred dollars a year; and said board shall have power to employ such other assistants as may be necessary for the transaction of their business. § 2, same ch. Board of elections, how appointed, oath of office. Registers, inspectors canvassers, and poll-clerks, how and when Board of elections, how appointed, oath of office. SEC. 530. On the first day of May, eighteen hundred and eighty-five, the mayor of the city of Brooklyn shall appoint four proper and suitable persons, not more than two of whom shall be of the same political party, who shall constitute the board of elections of the city of Brooklyn. No person holding public office of any kind under either the United States, State,county or municipal government, nor any employee of any bureau department, shall be eligible as a member of said board of election. And all votes cast at any general election or special election for any person who shall have, during any portion of the three months previous to such election, served as a member of said board of elections, for any office, shall be absolutely void, and each of said members shall take the oath of office before the city clerk of the city of Brooklyn, before entering upon the duties of his office. § 3, ch. 528, 1880. The following section 531 (being section 4, ch. 528, 1880) supersedes and takes the place of section 5, of ch. 575, 1872, as the same has been subsequently amended. Registers, inspectors, canvassers, and poll-clerks, how and when appointed. (And see section 562, post.) SEC. 531. On or before the fifteenth day of September, in each year, the said board of elections shall appoint registers, and on or before the fifteenth day of October, they appointed. shall also appoint inspectors and canvassers for each election district in the following manner, namely: they shall select to serve as registers of election two persons, one of whom, on State and national issues, shall be of different political faith and opinions from his associate, and that one appointed to represent the party in political minority on State and national issues in the city of Brooklyn shall be named solely by such of the members of said board of elections as are the representatives of such political minority; they shall, in like månner, select, to serve as inspectors of elections, four persons, two of whom, on State and national issues, shall be of different political faith and opinions from their associates, and the two appointed to represent the party in political minority, on State and national issues in the city of Brooklyn, shall be named solely by such of the members of said board of elections as are the representatives of such political minority; they shall also, in like manner, select, to serve as canvassers of elections, four persons, two of whom, on State and national issues, shall be of different political faith and opinions from their associates, and the two appointed to repre sent the party in political minority, on State and national issues in the city of Brooklyn, shall be named solely by such of the members of said board of elections as are the representatives of such political minority. The board shall also, previous to the opening of the polls at any election, select, in like manner, to serve as poll-clerks, two persons, one of whom, on State and national issues, shall be of different political faith and opinions from his associate, and the one appointed to represent the party in political minority, on State and national issues in the city of Brooklyn, shall be named solely by such of the members of said board of elections as are the representatives of such political minority. Such of the members of said board as are appointed to represent the party in political minority shall have power to remove, revoke the appointment, or fill any vacancy caused by the inability to serve, or resignation of any register, inspector, canvasser or poll-clerk appointed or designated by them, and to appoint another in his place, and the remaining members of said board shall have power to renew or revoke the appointment of any canvasser, inspector, register or poll-clerk appointed or designated by them, and to appoint another in his place, or to fill any vacancies caused by the resignation or other inability to serve of any register, inspector, canvasser or poll-clerk, appointed by them at any time before the opening of the polls on election day; and the said members shall have power respectively and in like manner to fill all other vacancies that may occur in positions theretofore filled by them. before the opening of the polls on election day. In case any poll-clerk, appointed, shall fail to attend at the opening of the polis on election day, the registers and Registers and in spectors, inspectors of like political faith may appoint one in his place, and in case of any vacancy occurring during the voting or canvassing of votes, such vacancy may be filled by the registers and inspectors or canvassers; and the said registers and inspectors shall recognize as the only proper and competent poll-clerks for the day of election, those persons who shall produce the certificates of appointment bearing the latest date, and none other; but in no case shall both the poll-clerks or registers, or more than two of the inspectors or canvasser in any election district, be of the same political faith and opinions. § 4, ch. 528, 1880. Registers and inspectors, duties of. SEC. 532. The said registers of election shall make the duties of registers of voters in the city of Brooklyn, and the said inspectors shall hold the elections as by law provided, and preside at the same and have and possess all the powers and be subject to all the duties and liabilities of inspectors of election, and for that purpose shall meet on or before the day of election and form a board of inspectors by appointing, or in case they cannot agree, by selecting by lot one of their members as chairman. The said registers shall meet on or before the last Tuesday of September, at the place designated for holding the poll of the next general election in their respective election districts, and organize themselves as a board of registry in each election district and appoint, or in case they cannot agree, select by lot one of their number chairman of the board. §5, same ch. SEC. 533. The said registers and inspectors of election, or a majority of them, shall make the registry hereinbe made. after provided for, in the city of Brooklyn, and the said and duties registers and inspectors shall hold the elections hereinof registry. after mentioned and preside at the same, and have and possess all the powers, and be subject to all the duties and liabilities of inspectors of election.
