No. 119. House bill entitled an act for the protection of sheep in the counties of Clarke, Frederick, Powhatan and Charlotte, was placed on the calendar, the rules having been suspended, on motion of Mr. Lewis, requiring its reference to a committee.

No. 139. Senate bill entitled an act to amend section 41 of an act entitled an act providing a charter for the city of Norfolk, in force March 16, 1871, was reported from the committee on counties, cities and towns.

No. 127. House bill giving the consent of this State to the purchase by the United States of a tract of land in the county of Henrico, and of two parcels of land in the town of Danville, to be used for military cemeteries, and exempting the same from State or corporation taxes (heretofore committed to the committee for courts of justice), was reported back.

No. 188. House bill to authorize the qualified voters of the county of Chesterfield to vote upon the question of the removal of the county courthouse, reported from the committee on counties, cities and towns, was read a first time.

No. 189. House bill to amend and re-enact the 4th section, chapter 118, of the Code of Virginia of 1873, in relation to wills, reported from the committee for courts of justice with a recommendation that it do not pass, was read a first time.

Leave of absence was granted Mr. Lewis for one day.

Resolved, That the committee for courts of justice be requested to consider the propriety of reporting a bill authorizing the governor, whenever in his judgment the public interest shall render it necessary, to suspend any executive officer of this Commonwealth from exercising the functions of his office for such time as he may deem necessary, provided that such suspension shall not continue longer than until the 10th day of the next session of the general assembly; and also, that in all cases of such suspension the governor shall make report of his reason for taking such action to the general assembly on the first day of its next session.

A message was received from the senate by Mr. Meem, who informed. the house that the senate had passed the following house bills:

No. 75. House bill entitled an act to amend and re-enact section 25 of chapter 158 of the Code of 1873, so as to increase the pay of grand juries.

No. 66. House bill entitled an act to incorporate the town of Big Lick.

No. 83. House bill entitled an act to amend an act entitled an act to authorize the board of supervisors for Craig county to contract for keeping in repair so much of Price's turnpike road as lies in said county, approved March 28, 1873.

No. 89. House bill entitled an act to amend and re-enact an act entitled an act to incorporate the town of Newbern, and to repeal act of 27th of May, 1852, entitled an act to incorporate the town of Newbern, in the county of Pulaski, in force March 4, 1872.

No. 72. House bill entitled an act to authorize the Valley mining and manufacturing company to borrow money, and to pledge the property of the company to secure the payment.

No. 87. House bill entitled an act to amend and re-enact section 17, chapter 23, Code of 1873, in relation to aids to the governor.

No. 73. House bill entitled an act to amend and re-enact an act entitled an act authorizing certain commissioners to sell a certain lot of land in Winchester belonging to the Winchester academy.

No. 93. House bill entitled an act to amend section 1, chapter 175, Code of 1873, with reference to injunctions.

No. 82. House bill entitled an act to authorize the Richmond, York river and Chesapeake railroad company to subscribe to the stock of the Baltimore, Chesapeake and Richmond steamboat company.

No. 96. House bill entitled an act to amend and re-enact section 20 of chapter 146 of the Code of 1873, relative to the limitation of suits.

No. 99. House joint resolution requesting the auditor of public accounts to furnish the general assembly with amounts of certain levies. And had passed the following house bills with amendments:

No. 68. House bill entitled an act repealing so much of the act in force December 28, 1871, entitled an act to provide for the protection of fish in the waters of New river and its tributaries, as applies to that portion of New river above the point where the dividing line between the counties of Carroll and Grayson crosses said river.

No. 15. House bill entitled an act authorizing D. A. Plecker to erect a toll-bridge across North river at Mount Crawford, in Rockingham county.

No. 76. House bill entitled an act to amend and re-enact section 4, chapter 6, of Code of Virginia (edition of 1873), in relation to vacancies in offices of governor and lieutenant-governor.

In which they respectfully request the concurrence of the house.

Mr. Round entered motions to reconsider the votes by which senate bill No. 72, entitled an act declaring a portion of Chippawamsic creek a lawful fence, was read a third time and passed.

The speaker laid before the house a communication from the secretary of the Commonwealth in relation to the action of a meeting of the board of canvassers held on the twenty-first instant, in regard to the special election for a member of the house of delegates from the county of Groenesville, and transmitting a certified copy of the abstract of votes and of the certificates of the commissioners; which were referred to the committee on privileges and elections.

The morning hour having expired, special order—

up.

On motion of Mr. Lewis, the special order was postponed for five minutes.

The amendment of the senate to strike out, in second line of first section, the word "Powhatan," was agreed to.

Mr. Lewis moved a reconsideration of the vote by which the amendment of the senate was agreed to; which was rejected.

The amendment of the senate to the title, to strike out "Powhatan," was agreed to.

Special order

No. 105. House bill to amend and re-enact sections 3, 4, 6 and 12 of chapter 154 of the Code of 1873, in relation to the jurisdiction of county courts, again came up.

On motion of Mr. Brooks, the special order was postponed twenty

minutes.

No. 137. House bill providing a charter for the city of Manchester,

was,

On motion of Mr. Brooks, taken up out of its order on the calendar.

The bill was read a second time, amended, and ordered to be engrossed to be read a third time.

Special order

No. 105. House bill to amend and re-enact sections 3, 4, 6 and 12 of chapter 154 of the Code of 1873, in relation to the jurisdiction of county courts, again came up.

Mr. Stuart offered the following resolution:

Resolved, That the bill reported by the committee for courts of justice, in relation to the jurisdiction of county courts, be and the same is hereby recommitted to said committee, with instructions to report in lieu thereof a bill restoring the jurisdiction of said courts, as it existed prior to the 1st day of August, 1873, and providing that the salaries of the judges of said courts shall be the same that they were prior to said 1st August, 1873, but that they shall be paid out of the treasuries of the respective counties.

Mr. McMullan moved to amend the resolution offered by Mr. Stuart by striking out the words "and providing that the salaries of the judges of said courts shall be the same that they were prior to said 1st August, 1873, but that they shall be paid out of the treasuries of the respective counties;" which was rejected.

Mr. Stuart called for the yeas and nays on his resolution; which was sustained.

On motion of Mr. Brooks, the house adjourned until to-morrow at 12 o'clock M.

The senate have agreed to a resolution from the house of delegates asking for the appointment of a committee of conference on senate bill No. 31, to define and declare the true intent and meaning of the act in force April 2d, 1873, entitled an act to amend and re-enact sections five and seven of an act to regulate and define the jurisdiction of the county and circuit courts, to prescribe the number of terms of the circuit court, and to fix the pay of county judges.

The speaker appointed Messrs. Blair, Brooks and Hudgin the committee of conference on the part of the house under the foregoing joint resolution.

No. 15. House bill entitled an act authorizing D. A. Plecker to erect a toll-bridge across North river at Mount Crawford, in Rockingham

county, was placed on the calendar, the rules having been suspended, on motion of Mr. Armstrong, requiring its reference to a committee.

No. 68. House bill entitled an act repealing so much of the act in force December 28th, 1871, entitled an act to provide for the protection of fish in the waters of New river and its tributaries, as applies to that portion of New river above Grayson springs, in Carroll county, was referred to the committee on Chesapeake and its tributaries.

No. 76. House bill entitled an act to amend and re-enact section 4, chapter 6 of Code of Virginia (edition of 1873), in relation to vacancies in offices of governor and lieutenant-governor, was referred to the committee for courts of justice.

No. 10. Senate bill entitled an act to provide for the lease of the penitentiary, was reported from the committee on asylums and prisons.

No. 71. Senate bill entitled an act to re-enact and amend 27th section of chapter 118 of Code of 1873, in reference to proof of wills where the witnesses thereto reside beyond the county where the will is offered for probate, was reported from the committee for courts of justice, with a recommendation that it do not pass.

No. 73. Senate bill entitled an act to amend and re-enact the first section of chapter 200 of the Code of Virginia (edition of 1873), in relation to grand juries, was reported from the committee for courts of justice, with a recommendation that the house insist on its amendments and ask for a committee of conference.

No. 104. House bill to amend and re-enact sections 6, 8 and 9 of chapter 90 of Code of 1860, in relation to weighing and selling live stock (heretofore recommitted to the committee on public property), was reported back with an amendment in the nature of a substitute.
