A communication from the senate, by their clerk, was read as follows:

The senate have indefinitely postponed house bill entitled

An act to authorize the county of Halifax to vote on the question of the fence law; No. 346.

They have passed house bills entitled

An act to amend the charter of the Mataoca manufacturing company, in the county of Chesterfield; No. 259.

An act to incorporate the town of Lawrenceville, in Brunswick county; No. 168.

An act to authorize John W. Ames, of Nansemond county, to erect a pier or wharf on Nansemond river; No. 181.

An act to authorize the qualified voters of the county of Chesterfield to vote upon the question of the removal of the county courthouse; No. 188.

An act for the relief of William W. Phelps, late sheriff of Wythe county; No. 196.

An act providing a remedy against turnpike companies failing to keep their roads in order; No. 203.

An act to incorporate the Abingdon academy of medicine; No. 220. An act to authorize the treasurer of Nansemond county to invest, by order of the school trustees of the town of Suffolk, the district school tax of the town of Suffolk; No. 231.

An act authorizing the school boards of Northumberland county to apply the funds derived from the tax on dogs; No. 232.

An act to incorporate the New river and Piedmont narrow gauge railroad company; No. 266.

An act to incorporate the Giles county iron company; No. 290.

An act to authorize the counties of King and Queen and King William to negotiate a loan or loans for the purpose of purchasing a steamboat; No. 296.

An act to authorize the payment of one hundred dollars to the Commonwealth's attorney of Clarke county for assistance in the prosecution of a criminal in the county of Frederick; No. 303.

An act to incorporate the Charlotte county immigration society; No. 327.

An act to appropriate the sum of five hundred dollars to the Richmond howitzers; No. 334.

An act to prevent obstructions to the free passage of fish in the streams of the State; No. 353.

An act to amend and re-enact an act to authorize the common council

of Winchester to borrow money, approved January 20, 1874; No.

An act to amend the second section of an act providing for the abolition of the office of superintendent of public buildings, approved February 28, 1874, and to provide additional compensation for the register of the land office for the discharge of the duties of the superintendent of public buildings devolved upon him; No. 368. And

An act for the relief of William E. Mickie, of the county of Charlotte; No. 373.

They have agreed to house joint resolution extending the privilege of taking fish to the land owners of Lancaster and other counties; No. 367.

They have agreed to the amendments proposed by the house of delegates to senate bill entitled

An act to increase the fees of sheriffs and other officers, and to amend and re-enact the 13th section of chapter 180 of the Code of 1873; No. 107.

They have passed bills entitled

An act to amend and re-enact section 73 of chapter 47 of the Code of 1873, so as to provide for listing children in townships or school districts every three years, instead of annually, às now provided by law; No. 321.

An act to incorporate the James river water power company; No. 266. And

An act to incorporate the tide water transportation company; No.

329.

In which bills they respectfully request the concurrence of the house of delegates.

No. 321. Senate bill, was read twice and placed on the calendar, the rules having been suspended, on motion of Mr. Magruder, requiring its reference to a committee.

No. 266. Senate bill, was read twice and referred to the committee on propositions and grievances.

No. 329. Senate bill, was read twice and referred to the committee on roads and internal navigation.

No. 333. Senate bill entitled an act to extend the corporate limits of the city of Petersburg so as to include therein a lot of land, the property of said city, was read twice and referred to the committee on counties, cities and towns.

No. 343. Senate bill entitled an act for the relief of Hiram P. Dillion, late township collector of Powell township, in the county of Scott, was read twice and placed on the calendar, the rules having been suspended, on motion of Mr. Jack Carter, requiring its reference to a committee.

No. 339. Senate bill entitled an act to amend and re-enact the 9th section of chapter 156 of the Code of 1873, for the transfer of causes from the counties of Amherst and Nelson to the court at Staunton, was reported from the committee for courts of justice.

No. 260. House joint resolution directing the president and directors of the Atlantic, Mississippi and Ohio railroad company to commence the work on the road to Cumberland gap, was reported from the committee on roads and internal navigation, with a recommendation that the house agree to the amendments of the senate.

The speaker appointed Messrs. Richmond, Brooks and Longley the committee under joint resolution appointing a committee to visit Kentucky and ascertain the probability of securing a railroad connection at Cumberland gap.

Mr. A. J. Clark offered the following resolution:

Resolved, That the resolution providing for night sessions be and the same is hereby rescinded.

The house refused to refer the resolution to a committee.

The resolution was agreed to.

Mr. Lovenstein offered the following resolution:

Resolved, That when this house adjourns to-day it adjourn to meet to-morrow at 6 o'clock P. M., which was agreed to.

An act to amend an act to incorporate the town of Rocky Mount, in the county of Franklin; in force February 17, 1873.

An act to incorporate the trustees of Fidelity Lodge, No. 1,379, of the Grand United Order of Odd- Fellows of the city of Richmond.

An act to amend and re-enact the 16th section of chapter 128 of the Code of 1873, in reference to commissioners in chancery.

An act to amend and re-enact sections 4, 17, 23 and 24 of an act entitled an act to provide a new charter for the town of Charlottesville; approved March 28, 1871.

An act to provide for paying to Baring Brothers & Company the amounts advanced by them for the State.

An act to authorize the councils of Norfolk city to drain or otherwise improve certain low or marsh land, and to change Back creek in said city.

An act to incorporate the Bank of Potomac and safe deposit company of Alexandria.

An act to amend and re-enact sections 1, 2, 4, 5, 7, 31 and 34, and to repeal section 36 of chapter 38 of the Code of 1873, and to provide additional sections for said chapter in relation to forfeited and delinquent lands.

An act to provide a charter for the town of Waynesboro', in the county of Augusta.

An act authorizing the register of the land office to correct error in land warrant.

An act for the relief of Warner Eubank, guardian of John J. Eubank, of Lancaster.

An act incorporating the Richmond Caledonian club of the city of Richmond, Virginia.

An act to incorporate the Warm springs company.

An act to authorize the mayor and council of the town of Suffolk to

borrow money.

An act to incorporate the Saint Mary's Catholic benevolent society of Fredericksburg, Virginia.

An act to provide an increase of the county and district school funds of Bland and Prince William counties.

An act for the relief of William E. L. Peebles and Benjamin F. Palmatary, sureties of J. D. Tatum, late collector of Templeton township, Prince George county, Virginia.

An act to provide for storage and preservation of the arms and ordnance stores of the State.

An act to amend and re-enact the 17th section of chapter 99 of the Code of 1873, for the protection of game.

The morning hour having expired, the house proceeded to the consideration of the business on the calendar.

No. 379. House bill to repeal section 10, chapter 100 of the Code of 1873, in relation to fishing in the Roanoke river west of the Blue Ridge, was,

On motion of Mr. Blair, taken up out of its order on the calendar. The bill was read a second time and ordered to be engrossed to be read a third time.

No. 345. Senate bill entitled an act appropriating the public revenue for the fiscal year 1873-'74 (unfinished business), came up.

The bill was further amended.

Mr. Bagwell moved to amend the bill by striking out the words "to Hampton normal and agricultural institute five thousand dollars." Mr. A. J. Clark moved the previous question, which was ordered. The amendment offered by Mr. Bagwell was rejected-yeas 59; nays 59.

On motion of Mr. Beaton, the vote was recorded as follows:

No. 260. House joint resolution directing the president and directors of the Atlantic, Mississippi and Ohio railroad company to commence the work on the road to Cumberland gap, came up.

Mr. Longley moved to pass by the joint resolution and have the amendments printed, which was rejected.

Mr. Lewis moved to lay the joint resolution on the table, which was rejected-yeas 45; nays 68.

And whereas the estimate for the construction of said Virginia and Kentucky road, at the time of the passage of the act aforesaid, was three millions five hundred thousand dollars, the said Atlantic, Mississippi and Ohio railroad shall deposit with some party, to be mutually agreed upon by the board of public works and said Atlantic, Mississippi and Ohio company, the amount of three million five hundred thousand dollars in the bonds of said company, as a security for the construction of said Virginia and Kentucky railroad, so soon as said Kentucky connections are established or guaranteed or assured as aforesaid.

Mr. Riddlebarger moved the pending question, which was ordered— yeas 64; nays 52.
